2. This is a petition under Article 226 & 227 of the Constitution of India read with Section 528 of BNSS filed on behalf of the petitioner seeking an independent CBI inquiry into the untimely death of petitioner’s mother including medical negligence by Dr. B.S. Ambedkar (BSA) Hospital, Rohini and Safdarjung Hospital, action against the erring police officials for dereliction of duty under Section 29 of Police Act, 1861 and direction for an FIR in Ct. 4. It is revealed by the contents of the petition and the submissions made that the Petitioner is already pursuing a remedy available to him under the law. His grievance is that there is no order on his application or the complaint under Section 156(3) Cr.P.C. However, the writ jurisdiction sought to be invoked by the Petitioner is not available to him in these circumstances at this stage.

5. As such, in view of the availability of the alternative remedy and being pursued by the Petitioner, this petition is pre-mature and not maintainable and accordingly, stands dismissed.
