1. The present petition has been filed seeking quashing of FIR No. 155/2016 dated 25th March, 2016 under Sections 354/354A/354B/354D/451 of the Indian Penal Code, 1860 (‘IPC’) registered at Police Station Roop Nagar and all proceedings emanating therefrom, on the basis of settlement.
2. Issue Notice.
3. Notice is accepted by the APP appearing on behalf of the State and by the parties who appear in person.
4. It is stated that a neighbourly dispute between the parties resulted in filing of the present FIR.
5. Now, the parties have settled their disputes and differences in terms of the Memorandum of Understanding (‘MoU’) dated 11th August, 2026, which has been filed as Annexure C to the petition.
6. The parties are present in Court and have been identified by their respective counsel and the Investigating Officer (‘IO’).
7. They inform the Court that they have settled the matter out of their own free will and without any coercion. They further state that they do not wish to pursue the present FIR any further and have no objection if the present petition is allowed.
8. Considering the fact that it is a dispute between neighbours and the parties have now resolved their disputes, there is no use continuing with the proceedings under the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer. Hence, it would be in the interest of justice to quash the aforementioned FIR and the proceedings pursuant thereto.
9. Even though the matter has been settled, the FIR were lodged in the year 2016 and the parties have settled the matter after 10 years. The petitioner, on account of his acts and omissions has taken up considerable time of the police and the courts in the present matter. In these circumstances, the petitioner would be liable to pay costs.
10. Accordingly, the present proceedings under FIR No.155/2016 registered at Police Station Roop Nagar and the proceedings pursuant thereto are hereby quashed subject to the petitioner paying costs of Rs.15,000/- to the Delhi High Court Bar Clerk’s Association within two (2) weeks from today.
11. The necessary compliance report shall be filed with the Registry within four (4) weeks from today.
12. The petition stands disposed of.
13. The pending application stands disposed of. AMIT BANSAL, J OCTOBER 12, 2026 Rzu
