1. Allowed, subject to all just exceptions. W.P.(CRL) 3233/2026

2. The present Writ Petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking issuance of a Writ in the nature of Habeas Corpus, directing the respondent nos.1 to 3 to produce Ms. X, the minor daughter of the petitioner.

3. On advance notice of this petition, Mr. Sanjay Lao, learned This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 15/10/2026 at 12:15:53

Senior Counsel appearing for respondent nos. 1 to 3, hands over a copy of the Status Report dated 12.10.2026, which, inter alia, states that Ms. X, along with a person named Mr. Piyush Nahar, has filed a Writ Petition before the Punjab and Haryana High Court, being CRWP No. 12259/2026, inter alia, praying for protection of life and liberty or, in the alternative, for sending Ms. X to Nari Niketan, as she is a minor. Though the order dated 07.10.2026 annexed with the Status Report does not indicate the same; however, the status report states that, in compliance with the directions passed by the Punjab and Haryana High Court on 07.10.2026, Ms. X was sent to the Children Home, Gandhi Vanita Ashram, Jalandhar City, Punjab on 10.10.2026, after getting her medically examined. A report in this regard has also been filed along with the Status Report. The Status Report is taken on record.

4. As a Writ Petition for the guardianship and welfare of the minor child is pending before the Punjab and Haryana High Court, and it is stated that, in compliance with the directions issued therein, the minor girl has been placed in the custody of a Children’s Home, we would refrain from considering the present Writ Petition at this stage.

5. We, accordingly, dispose of the present petition by reserving liberty in the petitioner to revive the same in case any such necessity arises in the future.
