1. The petitioner herein, who is presently confined in Central Jail No. 04, Tihar, New Delhi seeks release on emergency parole. The petitioner has filed this petition through Delhi High Court Legal Services Committee. The petitioner was convicted in FIR No. 490 of 2011, registered at P.S. Thereafter, the petitioner had filed a Special Leave Petition in the Supreme Court against the judgment dated 24.04.2026 being SLP (Crl.) undergo the remaining sentence. The fine has been duly paid.

3. It is submitted that the wife of the petitioner had suffered a bone fracture in her right leg on 16.04.2026. The condition of the wife of the petitioner is stated to have deteriorated. The petitioner draws attention to a medical certificate dated 12.09.2026, annexed to the present petition, in terms of which she has been advised bed rest. Although, there appears to be some merit in the petitioner’s request for emergency parole for a short period to attend to his wife, it transpires that no application for parole has been made to the competent authority.

4. In the circumstances, it is directed that the present petition shall be treated as petitioner’s application for parole under the Delhi Prison Rules, 2018. The same shall be forwarded by the Superintendent of the concerned Jail to the competent authority within a period of one week from today. The competent authority shall duly consider the matter and make an endeavour to pass a requisite order within a period of one week thereafter.

5. The petitioner shall, through the Jail Superintendent, also furnish the address where he proposes to stay and the updated medical records of his wife.

6. The decision shall be communicated to the petitioner and to the Delhi High Court Legal Services Committee (DHCLSC).

7. The petition is disposed of in the above terms.

8. Let the order be also communicated to the concerned Jail Superintendent for compliance.
