% 12.10.2026 CM APPL. 58231/2026 in MISC. APPEAL(PMLA) 31/2024
1. This application has been filed by the appellant praying for the following reliefs: “a) Permit the Applicant/Appellant and her family to continue residing in the subject property bearing No.35, First Floor , Khasra No.174, Lal Dora Abadi of Village Mohammadpur, R.K. Puram, New Delhi- 110066 during the pendency of the appeal without prejudice to the rights and contentions of either party;”
2. It is the case of the appellant that during the pendency of the present appeal, the appellant was in judicial custody and was not available at the address mentioned hereinabove. Therefore, finding the premises locked, the respondent affixed a notice dated 24.11.2022 which inter alia bound the appellant as under: “…Now therefore the said Mrs. Alemla Jamir, is hereby directed to immediately vacate and hand-over the peaceful possession of the said premises within 10 days from the date of receipt of this Notice, falling which this Directorate will be at liberty to initiate process for eviction as per the law.”
3. The learned Senior Counsel for the appellant submits that formally the possession of the premises was not taken over either physically or notionally by the respondent. He submits that therefore, now that the appellant has been released on bail, she wishes to reside at the above-mentioned premises.
4. The learned counsel for the respondent submits that it appears that post the aforesaid notice dated 24.11.2022 which was affixed, no further action has been taken to obtain the physical or notional position of the above premises from the appellant.
5. In that view, the possession of the subject property bearing No.35, First Floor, Khasra No.174, Lal Dora Abadi of Village Mohammadpur, R.K. Puram, New Delhi remains with the appellant, however, it shall be open to the respondent, if so advised, to initiate action in accordance with law if they intend to take the possession of the premises.
6. With the above clarification, the application is disposed of. MISC. APPEAL(PMLA) 30/2024 & CM APPL. 60975/2024 MISC. APPEAL(PMLA) 31/2024 & CM APPL. 60981/2024
7. The learned Senior Counsel for the appellants submits that in view of the order dated 16.09.2026 passed by the Supreme Court in SLP (Crl.) 16024/2025, titled Purushottam Dev Arya & Anr. v. Union of India & Ors., he has instructions to withdraw the present appeals without prejudice to the rights and contentions of the appellants.
8. The appeals are, accordingly, disposed of as withdrawn. Pending application(s) are also disposed of as infructuous. NAVIN CHAWLA, J ARUN BHARDWAJ, J OCTOBER 12, 2026/akr/pb
