1. In view of the fact that the decisions in Sushil Kumar v. Union of India1 as well as M Subramaniam v. Union of India2 have both been upheld by the Supreme Court by dismissal of the SLP preferred thereagainst and for want of any basis for us to hold that the OMs on which the Tribunal relied would not apply to the respondents, we do not find this to be a case deserving of interference.
