% 09.10.2026 CRL.M.A. 31796/2026 (exemption)

1. Allowed, subject to all just exceptions.

2. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (‘BNSS’) seeking quashing of FIR No. 945/2014 dated 19th August, 2014, registered at P.S. New Ashok Nagar, under Sections 420/34 of Indian Penal Code, 1860 (‘IPC’), and all proceedings arising therefrom, on the basis of settlement.

3. Issue notice.

4. Notice is accepted by the APP appearing on behalf of the State and by the respondent no.2, who is present in person.

5. The present FIR was registered pursuant to a complaint made by the respondent no.2 in respect of a familial property dispute between the parties, alleging that the petitioners no.1 and 2 had fraudulently registered a relinquishment deed for the ancestral property of the parties.

6. Now, the parties have settled their disputes in terms of the Settlement Agreement dated 29th July, 2026 before the Delhi High Court Mediation and Conciliation Centre, which has been placed on record as Annexure-C to the petition.

7. In terms of the settlement, the parties have resolved all their disputes and differences, and the petitioners have agreed to pay paid a total sum of Rs. 27,00,000/- to the respondent no.2 towards full and final settlement and purchase of 1/4th undivided share of the flat bearing No. C-112, ILA Co- operative Group Housing Society, Plot No. B-7, Vasundhara Enclave, Delhi – 110096.

8. Out of the aforesaid sum Rs.13,50,000/- has already been paid to the respondent no.2. A demand draft of the balance amount of Rs.13,50,000/- has been handed over to the respondent no.2 in Court today.

9. The respondent no. 2 is present in Court and has been identified by the Investigating Officer (‘IO’). He informs the Court that he has settled the matter of his own free will and without any coercion. He confirms that he has received the payment of the aforesaid amount from the petitioners and has no objection to the quashing of the present FIR.

10. The petitioners are also present in Court and have been identified by their counsel. They affirm the statement of the respondent no. 2.

11. Considering the above settlement between the parties, who are family members, no useful purpose would be served by continuing with the proceedings of the present FIR and it would be an unnecessary burden on the State exchequer.

12. Hence, it would be in the interest of justice to quash the present FIR and the proceedings pursuant thereto.

13. Consequently, FIR No. 945/2014, registered at P.S. New Ashok Nagar and the proceedings pursuant thereto are quashed.

14. The petition stands disposed of. AMIT BANSAL, J OCTOBER 9, 2026 Vivek/-
