1. Writ Petition under Article 226 of the Constitution of India has been filed on behalf of the Petitioner / Mr. Kannan Tiruvengadam seeking quashing of Show Cause Notice dated 09.07.2026 and consequential Order No.IBBI/DC/343/2026 dated 03.09.2026, passed by Respondent No.1.

2. It is explained that on account of alleged misconduct, Petitioner / Insolvency Professional was served with a Show Cause Notice dated 09.07.2026; and thereafter, disciplinary proceedings were held; and Respondent No.1 passed Final Order No.IBBI/DC/343/2026 dated

03.09.2026 suspending Petitioner’s registration for two years and directing replacement with another Resolution Professional / Liquidator.

3. It has also been stated against the said Order dated 03.09.2026, a Company Appeal (AT)(Ins) No. 1814/ND/2026 before the NCLAT on 07.09.2026 under Section 220(7) of Insolvency and Bankruptcy Code (Amendment) Act, 2026, which was heard on 29.09.2026 and Order on interim stay has been reserved. However, till date no Order on interim stay has been passed. Therefore, present Writ Petition has been filed for stay of Order dated 03.09.2026, till of the Order on interim stay Application, is passed.

4. Learned counsel for the Respondents has appeared on advance Notice, accepted Notice and has taken serious objections that once arguments on interim stay Application have been addressed before NCLAT and Order has been reserved, present Petition is not maintainable.

5. It is further submitted that Orders of NCLAT are Appealable before Hon’ble Supreme Court; In any case, present Writ is not maintainable. Submissions heard and record perused.

6. Considering that the statutory remedy of Appeal has already been availed by the Petitioner, in terms of Insolvency and Bankruptcy Code (Amendment) Act, 2026 and Orders have been reserved by NCLAT, it is most inappropriate for the Petitioner to parallelly seek stay of impugned Order dated 03.09.2026, by filing present Writ Petition. The statutory remedy as available, have already been availed.

7. In view of aforesaid observations, present Writ Petition along with pending Applications, is dismissed.
