2. Allowed subject to all just exceptions.

3. Application stands disposed of. CRL.M.C. 6906/2026

4. This is a petition, invoking the inherent and extraordinary powers, under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 whereby FIR No. 466/2017, registered under Sections 498A IPC & 3/4 D.P. Act registered at Police Station Khajuri Khas along with all consequential proceedings arising therefrom, has been sought to be quashed on the strength of the compromise arrived at between parties, who were tied through nuptial bond.

4. The marriage, between complainant (respondent No. 2 herein) and petitioner No. 1, was solemnized on 10.04.2016 as per Muslim Rites and Customs. Out of the said wedlock, one child was born.

5. However, on account of temperamental differences, the parties could not pull along too long and started residing separately since 10.01.2017. The complaint lodged by respondent No. 2, the abovesaid FIR was registered.

6. The present FIR is, thus, an outcome of a matrimonial dispute between the complainant/respondent No. 2 (wife) and petitioner No.1 (husband).

7. Learned APP for the State submits that the petitioner is the only accused and respondent No. 2 is the complainant/victim. The State has nothing much to say in view of the mutual settlement between parties secured by the Court annexed mediation process.

8. During the course of proceedings, the parties mutually and amicably resolved their disputes vide Settlement dated 17.02.2026 before the Mediation Centre, Karkardooma Courts, Delhi. It is stated that the parties have already been granted divorce by mutual consent (Talaq-Q-Mubarat) on 04.07.2026 by the Court of learned Principal Judge, Family Courts, North- East District, Karkardooma Courts, Delhi which was paved by the settlement dated 17.02.2026, Annexure ‘D’. Out of the total settlement amount of Rs. 6,00,000/-, the petitioner No. 1 (husband) has already paid a sum of Rs. 5,00,000/- and the remaining balance amount of Rs.1,00,000/- has been paid to Respondent No. 2 vide Banker Cheque No. 945049, drawn on State Bank of India, dated 05.08.2026 today before the Court.

9. The petitioner and Respondent No. 2 who are present in the Court have been identified by their respective counsel and the Investigating Officer.

10. Respondent No. 2 also endorses and confirms that the matter has been amicably settled with the petitioner without any pressure, force, thereafter, coercion etc. and that she has received the entire settlement amount.

11. In view of the settlement arrived at between the parties, continuing with the criminal proceedings would serve no useful purpose, especially, when dispute does not involve any public interest and is primarily and essentially private in nature. In any case, even the complainant/respondent No. 2 does not wish to press any charges against the petitioner.

12. Consequently to secure the ends of justice, the FIR No. 466/2017 registered under Sections 498A IPC & 3/4 D.P. Act registered at Police Station Khajuri Khas alongwith all consequential proceedings emanating therefrom, is hereby quashed.

13. The present writ petition stands allowed and disposed of accordingly together with pending applications, if any..
