2. By way of present petition filed under Section 482 Cr.P.C. read with Section 528 of BNSS, 2023, the petitioners seek quashing of FIR No. 0303/2020, registered under Sections 498A/406/354/354A//323/34 IPC at P.S. Jyoti Nagar, Delhi on the ground that the parties have amicably settled their disputes.

3. The marriage between complainant (respondent No. 2 herein) and petitioner No. 1 was solemnized on 02.02.2019 as per Muslim Rites and rituals. One child was born from the abovesaid wedlock.

4. However, on account of temperamental differences, the parties started residing separately since 25.04.2019 and upon a complaint lodged by respondent No. 2, the abovesaid FIR was registered.

5. The present FIR is an outcome of a matrimonial dispute between the complainant/respondent No. 2 (wife) and petitioner No.1 (husband) whereas petitioner Nos. 2 to 5 are the in-laws of the complainant.

6. Learned APP for the State submits that the petitioners are the only accused persons and respondent No. 2 is the complainant/victim.

7. Learned counsel for the petitioners submits that the parties have settled their dispute vide Settlement/Agreement before Delhi Mediation Centre, Karkardooma Courts, Delhi dated 19.09.2024. It is stated that the parties have already been granted divorce by mutual consent vide Mubarat before the Court of learned Principal Judge, Family Courts, Shahdara Karkardooma, Delhi on 21.10.2024. It is further submitted by the Respondent No. 2 that she has received the entire amount in terms of the settlement from the Petitioner No.1. As such, in terms of the settlement dated 19.09.2024, respondent No. 2 is now left with no claim whatsoever against the petitioners.

8. The petitioners who are present in the Court have been identified by their counsel and the Investigating Officer. Respondent No.2, who is present in the Court, has also been identified by the Investigating Officer.

9. Respondent No. 2 states that she has entered into the aforesaid mediation settlement/agreement with her own free will, volition and without any coercion or pressure. She further states that she has no objection if the present FIR and consequent proceedings are quashed.

10. The parties shall remain bound by the statements made before the Court.

11. In view of the settlement arrived at between the parties, it is evident that continuing with the criminal proceedings would serve no useful purpose, especially, when dispute does not involve any public interest and is primarily, private in nature. In any case, even the complainant/respondent No. 2 does not wish to press any charges against the petitioner.

12. Consequently to secure the ends of justice, the FIR No. 0303/2020, registered under Sections 498A/406/354/354A//323/34 IPC at P.S. Jyoti Nagar, Delhi, alongwith all consequential proceedings emanating therefrom, is hereby quashed.

13. The present writ petition stands allowed and disposed of accordingly. Pending application(s), if any, also stand disposed of.
