% 09.10.2026 CRL.M.A. 31891/2026 (exemption)

1. Allowed, subject to all just exceptions.

2. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (‘BNSS’) seeking quashing of FIR No.0776/2023 dated 31st December, 2023, registered at P.S. Aman Vihar, Delhi for offence under Sections 498A/406/34 of Indian Penal Code, 1860 and all proceedings arising therefrom, on the basis of settlement.

3. Issue Notice.

4. Notice is accepted by the APP appearing on behalf of the State and by the respondent no.2, who is present in person.

5. The petitioner no.1 is the husband of the respondent no.2 and the petitioners no.2, 3 and 4 are family members/relatives of petitioner no.1. The marriage of the petitioner no.1 and the respondent no.2 was solemnised on 6th February, 2022 as per Hindu rites and ceremonies. No child was born out of the wedlock.

6. Marital disputes arose between the petitioner no.1 and the respondent no.2, which resulted in filing of the present FIR on 31st December, 2023.

7. Now, the parties have settled their disputes in terms of the Memorandum of Understanding dated 7th July, 2025, which has been placed on record as Annexure P-3 to the petition. Divorce of divorce dated 1st December, 2025 has also been placed on record as Annexure P-6 to the petition.

8. The respondent no.2 is present in Court and has been identified by the Investigating Officer (“I.O.”). She informs the Court that she has settled the matter of her own free will and without any coercion. She further states that she has no objection to quashing of the present FIR.

9. The petitioners are also present in Court and have been identified by their counsel. They affirm the statement of the respondent no.2 and undertake to abide by the terms of settlement arrived at between the parties.

10. Considering the above settlement between the parties, no useful purpose would be served by continuing with the proceedings of the present FIR and it would an unnecessary burden on the State exchequer. Hence, it would be in the interest of justice to quash the present FIR and the proceedings pursuant thereto.

11. Consequently, the FIR No.0776/2023 dated 31st December, 2023, registered at P.S. Aman Vihar, Delhi and the proceedings pursuant thereto are quashed.

12. The petition stands disposed of.

13. The pending application stands disposed of. AMIT BANSAL, J OCTOBER 9, 2026 Vivek/-
