1. Hybrid mode. CRL.M.A. 4519/2024 (Seeking Stay of Order Dated 10.11.2023).

2. Learned counsel for the Petitioner had indicated in pre-lunch session that petitioner Ajit @ Ajit Kumar and Respondent Sapna @ Sapna Rani had dissolved their marriage vide “Decree of Divorce” dated 06.12.2024 on the basis of mutual settlement arrived at between them vide orders dated 19.09.2024.

3. In terms of the statements made by both the parties before the trial court on 06.12.2024, pursuant to the mutual settlement dated 19.09.2024, learned counsel for the petitioner seeks stay of the order dated 10.11.2023 whereby interim maintenance awarded to the respondent Sapna was assessed / calculated as per the notification qua minimum wages as per the Minimum Wages Act prevailing in Delhi. However, it has been argued that Petitioner This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Ajit @ Ajit Kumar, at the time of awarding interim maintenance was a native of Sonepat Haryana and was getting wages of „Driver‟ as per notification qua minimum wages prevailing in the state of Haryana. It is submitted that the petitioner, at the relevant time, being resident of Haryana was therefore getting minimum wages prevalent in Haryana and that was less than the rates of minimum wages given in Delhi. Thus, the calculation was defective, since the fundamental statistical facts were incorrect. It was that correction which was sought to be made through the instant petition.

4. In view of the fact that now the parties have amicably resolved their matrimonial dispute by „mutual consent‟ in terms of the full and final settlement arrived at between them vide settlement dated 19.09.2024, which is part of record, thus the issue of „maintenance‟ is no longer required to be looked into, as the settlement comprehensively resolves the whole matrimonial dispute.

5. In view of these facts and circumstances, order dated 20.10.2022 passed by learned MM, Dwarka for increasing maintenance alongwith payment of litigation and rental cost and consequent confirmation through order dated 10.11.2023 passed by learned ASJ, Dwarka upholding the said order, are set-aside.

6. The petition stands disposed of accordingly, together with the pending application(s), if any.
