1. By way of this petition under Section 11 of the Arbitration and Conciliation Act, 1996 [hereinafter, “the Act”], the petitioner seeks appointment of an arbitrator to adjudicate the disputes between the parties under a Supply Contract dated 21.03.2024 (amended on 05.09.2024) [hereinafter, “the Contract”].

2. I have heard Mr. Rishi Kapoor, learned counsel for the petitioner, and Mr. Sunil Prakash Sharma, learned counsel for the respondent.

3. The Contract contains a dispute resolution clause [Clause 13.1], which provides for arbitration by a sole arbitrator. As per Clause 13.1.2 of the Contract, New Delhi has been designated as the seat of arbitration. This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 12/10/2026 at 10:38:56

4. Pursuant to disputes arising between the parties, the petitioner addressed a demand notice dated 21.09.2026 to the respondent, and thereafter, invoked arbitration vide a notice dated 19.02.2026. As the notice failed to elicit a response, the present petition has been filed before this Court.

5. The parties were referred to mediation by an order dated 21.07.2026, however, the mediation was unsuccessful.

6. Mr. Sharma states that he has instructions not to oppose the present petition.

7. Having regard to the above, and with the consent of learned counsel of the parties, the petition is disposed of, with the following directions:

a. Ms. Chand Chopra, Advocate [Tel: 9915907494] is appointed as the arbitrator to adjudicate disputes between the parties under the Contract dated 21.03.2024.

b. The arbitration will be held under the aegis of Delhi International Arbitration Centre [“DIAC”] and will be governed by the Rules of DIAC, including as to remuneration of the learned Arbitrator.

c. The learned Arbitrator is requested to furnish a declaration under Section 12 of the Act, prior to entering upon the reference.

8. Needless to say, all rights and contentions of the parties, including as to arbitrability and maintainability of the claims, and on merits, are left open for adjudication by the learned Arbitrator.
