1. This hearing has been done through hybrid mode.

2. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), read with Article 226 of the Constitution of India, seeking quashing of FIR No. 203/2022, registered at Police Station Dwarka North, Delhi, under Sections 498A/406/34 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), along with all consequential proceedings arising therefrom, on the basis of an amicable settlement arrived at between the parties.

3. Issue notice. Learned APP for the State accepts notice on behalf of the State.

4. The petitioners and respondent No. 2 are present before this Court and have been duly identified by the Investigating Officer (IO) concerned.

5. Briefly stated, the marriage between petitioner No. 1 and respondent

No. 2 was solemnised on 11.05.2014 at Hazaribagh, Jharkhand, in accordance with Hindu rites and ceremonies. Out of the said wedlock, a son, namely Ayush @ Naman Raj Mehta, was born on 30.09.2017. Owing to matrimonial discord and temperamental differences, the parties started residing separately with effect from 15.06.2021. Thereafter, respondent No. 2 lodged the present FIR against the petitioners. During the pendency of the proceedings, with the intervention of family members and the Mehta Samaj Panchayat, the parties amicably resolved their matrimonial disputes in terms of the Panchayat decision dated 19.12.2023. Pursuant thereto, the marriage between petitioner No. 1 and respondent No. 2 was dissolved by a decree of divorce by mutual consent dated 31.07.2024, passed by the learned Principal Judge, Family Court, Hazaribagh, Jharkhand.

6. Learned counsel for the petitioners submits that, in terms of the settlement dated 19.12.2023, petitioner No. 1 agreed to pay a total sum of ₹6,50,000/- (Rupees Six Lakh Fifty Thousand only) to respondent No. 2 towards full and final settlement of all her matrimonial claims. Out of the said amount, a sum of ₹4,00,000/- (Rupees Four Lakh only) had already been paid to respondent No. 2 at the time of the second motion proceedings. It is further submitted that the balance amount of ₹2,50,000/- (Rupees Two Lakh Fifty Thousand only) has been handed over to respondent No. 2 today in Court by way of Demand Draft bearing No. 000817. Accordingly, the entire settled amount stands paid and the terms of the settlement have been duly complied with.

7. On a query made by this Court, respondent No. 2, who has been duly identified by the IO concerned, states that she has entered into the settlement voluntarily, of her own free will, without any force, coercion or undue influence. She further acknowledges receipt of the entire settled amount of ₹6,50,000/- and states that she has no surviving matrimonial claim against the petitioners. She has no objection if the present FIR and all proceedings emanating therefrom are quashed.

8. Considering that the disputes between the parties are matrimonial in nature, the parties have amicably resolved their differences, their marriage already stands dissolved by a decree of divorce by mutual consent, and the entire settled amount has been paid to respondent No. 2, this Court is of the view that no useful purpose would be served by continuing the criminal proceedings. In the facts and circumstances of the present case, continuation of the proceedings would only prolong the dispute between the parties. Accordingly, this Court finds it appropriate to exercise its inherent jurisdiction under Section 528 of the BNSS.

9. Accordingly, FIR No. 203/2022, registered at Police Station Dwarka North, Delhi, under Sections 498A/406/34 IPC, along with all consequential proceedings arising therefrom, is hereby quashed qua the petitioners.

10. The present petition, along with pending application(s), if any, stands disposed of.

11. Copy of the order be communicated to the concerned learned Trial Court for necessary action and compliance.

12. The order be uploaded on the website forthwith. MADHU JAIN, J OCTOBER 7, 2026/prg/P
