% 07.10.2026 CRL.M.A. 15971/2026 (exemption)

1. Allowed, subject to all just exceptions.

2. The present petition has been filed seeking quashing of FIR No.630/2021 dated 14th November, 2021, registered at P.S. Ambedkar Nagar, Delhi, for offence under Sections 498A/406/34 of IPC and all proceedings arising therefrom, on the basis of settlement.

3. Issue Notice.

4. Notice is accepted by the APP appearing on behalf of the State and counsel appearing on behalf of respondent no.2.

5. The petitioner no.1 is the husband of the respondent no.2 and the petitioners no. 2, 3 and 4 are the family members of the petitioner no.1. The marriage of the petitioner no.1 and the respondent no.2 was solemnized on 14th April, 2019 as per Hindu rites and ceremonies. No child was born out of wedlock.

6. Marital disputes arose between the petitioner no.1 and the respondent no.2, which resulted in filing of the present FIR on 14th November, 2021 by the respondent no.2.

7. Now, the parties have settled their disputes in terms of the Settlement Deed dated 17th March, 2025, executed between the parties, which has been placed on record as Annexure C to the petition. In terms of the settlement, out of a total amount of Rs. 3,50,000/-, a sum of Rs. 2,00,000/- has been paid by the petitioner no.1 to respondent no.2 and a cheque for the remaining amount of Rs.1,50,000/- has been handed over during the course of the hearing.

8. The decree of divorce dated 3rd July, 2025 has been filed as Annexure D to the petition.

9. It is further agreed that the respondent no.2 agrees and accepts that she has resolved/settled all her disputes/claims with the petitioner no.1 and the present petition is being supported by an affidavit of the respondent no.2 whereby she has given her "no objection" for the quashing of the FIR in question having settled all her disputes/claims with the petitioners.

10. The respondent no.2 is present in Court and has been identified by her counsel as well as by the Investigating Officer (‘I.O.’). She informs the Court that she has settled the matter of her own free will and without any coercion. She further states that she has no objection to quashing of the present FIR.

11. The petitioners are also present in Court and have been identified by their counsel. They affirm the statement of the respondent no.2 and undertake to abide by the terms of settlement arrived at between the parties.

12. Considering the above settlement between the parties, no useful purpose would be served by continuing with the proceedings of the present FIR and it would an unnecessary burden on the State exchequer. Hence, it would be in the interest of justice to quash the present FIR and the proceedings pursuant thereto.

13. Consequently, the FIR No.630/2021 registered at P.S. Ambedkar Nagar, Delhi, and the proceedings pursuant thereto are quashed.

14. The petition stands disposed of. AMIT BANSAL, J OCTOBER 7, 2026 ds
