1. The present application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (“BNSS”), seeking grant of anticipatory bail to the petitioner, i.e., Sh. Chandan Singh Yadav, in connection with FIR No. 0114/2026 dated 01st September, 2026, under Section 318(4)/336(3)/340(2)/61(2)(a) of the Bharatiya Nyaya Sanhita, 2023 (“BNS”) and Section 91 of the Rights of Persons with Disabilities Act, 2016 (“RPD Act”), registered at Police Station (“PS”) Maurice Nagar, North, Delhi.

2. Issue Notice.

3. Notice accepted by the learned Additional Public Prosecutor (“APP”) for the State.

4. The facts of the present case, culled out from the documents on record, are as follows:

4.1. Upon receipt of credible information regarding a well-organized racket involving forged Disability Certificates, on 31st August, 2026, a raid was conducted by the Police, pursuant to which, Sh. Lalit Kumar @ Adiya was apprehended with 16 different Disability Certificates of different persons.

4.2. On disclosure by Sh. Lalit Kumar, one Sh. Adesh Singh was arrested, who then disclosed the role of the petitioner herein as the person whom he used to approach for preparation of the forged Disability Certificates.

4.3. A raid was conducted by the Police to apprehend the petitioner, however, he was found absconding. A notice under Section 35(3) of the BNSS was served upon the petitioner’s father, but the petitioner failed to join the investigation.

5. It is the case on behalf of the petitioner that the petitioner is a businessman and has no dealing with the accused, Sh. Adesh Singh.

6. Learned counsel appearing for the petitioner submits that the petitioner knows Sh. Adesh Singh on account of the fact that the petitioner is a businessman and deals with products used in automobiles.

7. He further submits that the petitioner has nothing to do with the preparation of fake Disability Certificates for admission to colleges.

8. Per contra, learned APP for the State submits that the petitioner along with others is involved in the scam of publishing and making forged Disability Certificates for the purposes of securing admission to various colleges in University of Delhi.

9. He submits that the name of the petitioner has been disclosed by the co- accused, Sh. Adesh Singh, upon the said accused person’s apprehension by the Police.

10. He further submits that the petitioner’s name has not only been disclosed by the co-accused, Sh. Adesh Singh, but there are also financial transactions between Sh. Adesh Singh and the petitioner.

11. Learned APP for the State submits, upon instructions from the concerned Investigating Officer (“IO”), that when the co-accused, Sh. Adesh Singh, was arrested on 12th September, 2026, a WhatsApp message dated 11th September, 2026, was discovered from his mobile phone. The said message was sent by the petitioner herein to the said co-accused stating that since the Police was looking for them, they should abscond.

12. He submits that the mobile phone of the co-accused, Sh. Adesh Singh, has been sent to the Special Cell for retrieving all the data in this regard.

13. He further submits that the Police needs a custodial interrogation of the petitioner for the purposes of interrogating the petitioner as regards the scam with regard to fake Disability Certificates.

14. Learned APP for the State that the present matter is presently at the stage of investigation.

15. He further submits that two notices dated 17th September, 2026 and 24th September, 2026 were also issued to the petitioner, but he did not join the investigation, on account of which Non-Bailable Warrant (“NBW”) has been issued against the petitioner.

16. Having heard learned counsel appearing for the parties, this Court notes that the name of the petitioner was disclosed by co-accused Adesh Singh. Further, two notices dated 17th September, 2026 and 24th September, 2026

were issued by the Police to the petitioner. However, the petitioner has not joined the investigation.

17. This Court also takes note of the fact that there are financial transactions between the parties and the co-accused, Sh. Adesh Singh.

18. It is noted that in a period of three months amounts of approximately Rs. 07 Lacs have been transferred by co-accused, Sh. Adesh Singh, to the petitioner.

19. Further, as per the submission made by learned APP for the State, Call Detail Record (“CDR”) analysis also shows connection between the petitioner and the other co-accused persons.

20. It is also to be noted that the investigation in the present matter is still going on, and the charges involved are very serious with regard to preparation of forged Disability Certificates.

21. Accordingly, considering the fact that the matter is still at the stage of investigation and the investigation requires tracing of an entire network with regard to the making of fake Disability Certificates, this Court is of the view that the custodial interrogation would be more effective in eliciting the truth during the investigation.

22. Having regard to the conspectus of the facts and circumstances of the present case, this Court does not consider it a fit case for grant of anticipatory bail.

23. The present petition along with the pending application is accordingly dismissed.

24. It is clarified that the observations made in the present order are solely for the purpose of adjudication of the present bail application, and the same shall not be construed as an expression of opinion on the merits of the case nor shall prejudice the rights and contentions of the parties at any stage of the proceedings.
