1. This hearing has been conducted through hybrid mode.

2. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [hereinafter referred to as 'BNSS'], seeking quashing of FIR No. 764/2023 dated 23.10.2023, registered at Police Station New Usmanpur, North East District, Delhi for offences under Sections 498A and 406 of the Indian Penal Code, 1860 [hereinafter referred to as 'IPC'] and Section 4 of the Dowry Prohibition Act, 1961, and all proceedings emanating therefrom, including the charge-sheet filed under Sections 498A and 406 read with Section 34 of IPC and Section 4 of the Dowry Prohibition Act, on the basis of an amicable settlement between the parties.

3. Issue Notice. Learned APP for the State accepts notice on behalf of the State.

4. The Petitioners and Respondent No.2 are present before this Court and have been duly identified by the concerned Investigating Officer [IO].

5. Briefly stated, the marriage between petitioner No. 1 and respondent No. 2 was solemnised on 14.10.2022 according to Muslim rites and customs. No child was born from the wedlock. Owing to matrimonial discord, the parties started residing separately on 29.03.2023. A complaint made by respondent No. 2 culminated in the registration of the aforesaid FIR against the petitioners. Upon completion of the investigation, a charge-sheet was filed and the criminal proceedings are stated to be pending before the competent Trial Court.

6. During the pendency of the proceedings, the parties executed a Memorandum of Understanding [MoU] dated 08.07.2026 and amicably settled their matrimonial disputes. Petitioner No. 1 agreed to pay a total sum of ₹2,00,000/- to respondent No. 2 in full and final settlement of her claims. The petition records that ₹1,00,000/- has already been paid and that the balance amount of ₹1,00,000/- is payable at the time of quashing of the FIR. The marriage was thereafter dissolved by Talaq-e-Mubarat on 26.07.2026. Respondent No. 2 has also filed an affidavit stating that she has no objection to the quashing of the FIR.

7. On a query made by this Court, respondent No. 2 who has been duly identified by the Investigating Officer, states that she entered into the Memorandum of Understanding [MoU] dated 08.07.2026 of her own free will and without any pressure, coercion, undue influence or threat. She further states that she has no objection if the aforementioned FIR and all proceedings emanating therefrom are quashed

8. In view of the above, since the parties have amicably resolved their matrimonial disputes under the Memorandum of Understanding [MoU] dated 08.07.2026, of their own free will and without any pressure, coercion or undue influence, no useful purpose would be served by continuing the proceedings. Rather, continuation of the proceedings may only give rise to further acrimony between the parties. In these circumstances, this Court is of the view that the interest of justice would be served by bringing the proceedings to an end.

9. Accordingly, FIR No. 764/2023 dated 23.10.2023, registered at Police Station New Usmanpur, North East District, Delhi for offences under Sections 498A and 406 IPC and Section 4 of the Dowry Prohibition Act, 1961, and all consequential proceedings emanating therefrom, including the charge-sheet filed are hereby quashed.

10. Therefore, the present petition is allowed and thereby, disposed of.

11. Pending application[s], if any, also stand[s] disposed of.

12. A copy of this order be sent to the concerned learned Trial Court for necessary information and compliance.

13. The order be uploaded on the website forthwith. MADHU JAIN, J OCTOBER 7, 2026/prg/PG
