1. Allowed, subject to all just exceptions. CRL.M.C. 3946/2026

2. The present petition has been filed under Section 582 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (‘BNSS’) seeking quashing of FIR No.249/2024 dated 22nd July, 2024, registered at P.S. Mohan Garden, Dwarka, New Delhi, under Sections 323/451/506/34 of the Indian Penal

Code (‘IPC’) and all proceedings arising therefrom, on the ground of settlement.

3. Issue notice.

4. Notice is accepted by the APP appearing on behalf of the State and the counsel appearing on behalf of the respondent no.2.

5. The respondent no.2 is the ex-husband of petitioner no.3, and the petitioners no.1, 2, 4, 5 and 6 are the family members of the petitioner no.3. The marriage of the petitioner no.3 and the respondent no.2 was solemnised on 22nd November, 2008 as per Hindu rites and ceremonies. A child was born out of the said wedlock.

6. Marital disputes arose between the petitioner no.3 and the respondent no.2, which resulted in the filing of the present FIR on 22nd July, 2024.

7. Now, the parties have settled their disputes in terms of the Memorandums of Understanding dated 19th February, 2025 and 7th November, 2024, which have been placed on record as Annexure C and Annexure D, respectively to the petition.

8. In terms of the settlement, it was decided that the petitioner no.3 and the respondent no.2 will seek divorce by way of mutual consent. Further, it was decided that the respondent no.2 shall pay Rs. 47 Lakhs to the petitioner no.3 towards full and final settlement of all her claims. The custody of the child shall remain with the petitioner no.3.

9. The petitioner no.3 is present in Court and has been identified by her counsel as well as by the Investigating Officer (“I.O.”). She informs the Court that she has settled the matter of her own free will and without any coercion.

10. The respondent no.2 is also present in Court and has been identified by his counsel. He affirms the statement of the petitioner no.3 and undertakes to abide by the terms of settlement arrived at between the parties. He informs the Court that he has settled the matter of his own free will and without any coercion. He further states that he has no objection to quashing of the present FIR.

11. Considering the above settlement between the parties, no useful purpose would be served by continuing with the proceedings of the present FIR and it would an unnecessary burden on the State exchequer. Hence, it would be in the interest of justice to quash the present FIR and the proceedings pursuant thereto.

12. It is directed that the settlement executed between the petitioner no.3 and respondent no.2, as well as this order, shall have no effect on the legal rights of the minor child in the future.

13. Consequently, the FIR No. 249/2024 registered at P.S. Mohan Garden and the proceedings pursuant thereto are quashed.

14. The petition stands disposed of. AMIT BANSAL, J OCTOBER 7, 2026 ds
