1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:- “a. Issue an appropriate Writ including a Writ of mandamus to direct the Respondents to allow the petitioner for Inter College Migration for the Academic Sessions 2026-27 from Swami Shardhhanand College-Respondent No.2 and allow admission of petitioner in Ramjas College Respondent No.3 in B.Sc. ( Life Science) 3rd Semester against available seats. …”

2. The brief facts of the case are that the petitioner seeks to migrate from respondent No. 2 namely Swami Shraddhanand College to respondent No. 3

namely Ramjas College in B.Sc. (Life Science) 3rd Semester against available seats.

3. The petitioner is seeking migration because the father of the petitioner is residing at H. No. 69-A, 2nd Floor, BLK-A, Kamla Nagar, Malka Ganj, North, Delhi-110007 and suffering from many ailments. The respondent No. 3 college is within walkable distance from the residence of the father of the petitioner.

4. My attention has been drawn to Annexure P8 which is an application for No Objection Certificate (“NOC”) submitted to the Principal of respondent No. 2 by the petitioner and it is stated that the respondent No. 2 had granted the said NOC on 08.09.2026.

5. Mr. Mathur, learned counsel for the respondent No. 3 college, has no objection to the petitioner taking admission in the respondent No. 3 college.

6. Mr. Rupal, learned counsel for the respondent No. 1, states that the last date for seeking migration was 31.08.2026 and that there has been a delay on part of the petitioner.

7. I have heard learned counsel for the parties and perused the documents placed on record.

8. The petitioner on 25.08.2026 applied for issuance of NOC, which was received on 31.08.2026 by the respondent No. 2 college.

9. The petitioner applied for issuance of an NOC within the aforesaid timeline and the same was delayed for reasons not attributable to the petitioner. Furthermore, if the petitioner is allowed to migrate, there is no prejudice that will be caused to any college, as both the colleges have consented to the migration of the petitioner. I am of the view, that only on account of this technical consideration, the petitioner cannot be made to suffer.

10. For the said reasons, the petition is allowed and the petitioner will be permitted to migrate from respondent No. 2 namely Swami Shradhhanand College to respondent No. 3 namely Ramjas College for the academic session of 2026-27 in B.Sc. (Life Science) 3rd Semester.

11. With aforesaid directions, the petition, along with any pending applications, is disposed of.
