1. Allowed, subject to all just exceptions. CRL.M.C. 7521/2026 & CRL.M.C. 7550/2026

2. The present petitions have been filed seeking quashing of FIR No.

dated 3rd April, for offence under Sections 118(1)/126(2)/3(5) of the Bhartiya Nyaya Sanhita, 2023 registered at Police Station Ghazipur and all proceedings emanating therefrom, on the ground of settlement.

3. Issue Notice.

4. Notice is accepted by the APP appearing on behalf of the State and by the respondent no.2 who appears in person.

5. Disputes arose between the parties relating to a driving incident at a toll booth which resulted in an altercation between the petitioners and the respondent no.2. It is alleged that during the altercation, the respondent no.2 was restrained and struck with a sharp object, which resulted in filing of the present FIR by the respondent no.2.

6. Now, the parties have settled their disputes and differences in terms of the Settlement Deed dated 8th April, 2026, copy of which has been filed as Annexure P-3 in both the petitions.

7. The respondent no.2 is present in Court and has been identified the Investigating Officer (‘IO’). The respondent no.2 informs the Court that he has settled the matter out of his own free will and without any coercion. He further states that he does not wish to pursue the present FIR any further and have no objection if the present petitions are allowed.

8. The petitioners are also present in Court and have been identified by their counsel. They affirm the statement of the respondent no.2 and undertake to abide by the terms of settlement arrived at between the parties.

9. Considering the fact that the altercation happened on the spur of the moment and now the parties have now resolved their disputes, there is no use continuing with the proceedings under the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer. Hence, it would be in the interest of justice to quash the aforementioned FIR and the proceedings pursuant thereto.

10. Accordingly, the present proceedings under FIR No.110/2026 registered at Police Station Ghazipur and the proceedings pursuant thereto are hereby quashed, subject to the payment of compensation of Rs.10,000/- by each of the petitioners to the respondent no.2 within two (2) weeks from today.

11. The necessary compliance report shall be filed with the Registry within four (4) weeks from today.

12. The petitions stand disposed of accordingly. AMIT BANSAL, J OCTOBER 7, 2026 Rzu
