1. This hearing has been done through hybrid mode.

2. The present petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘BNSS’) seeking the following reliefs: “issue a writ of certiorari, or any other appropriate writ, order or direction, quashing and setting aside the impugned Notice dated 22.09.2026 issued by Respondent No. 2 under Section 94 BNSS, insofar as it seeks any information or data pertaining to the Petitioner and his X handle “@ManishSharmaIYC”;

(b) issue a writ of mandamus, or any other appropriate writ, order or direction, directing Respondent No. 1 to forthwith furnish to the Petitioner a copy of FIR No. 448/26, registered at P.S. Cyber, South-West District, Delhi;

(c) direct Respondent No. 2 not to disclose, share or part with any subscriber information, login logs, linked credentials, or associated content pertaining to the Petitioner and/or his handle “@ManishSharmaIYC”, pursuant to the impugned Notice or otherwise, pending disposal of the present petition; (d) pass any other order(s) as this Hon’ble Court may deem fit and proper in the facts and circumstances of the present case, in the interest of justice.”

3. Learned counsel for the petitioner submits that a notice under Section 94 of the BNSS has been issued by the Delhi Police wherein, in the profile names, the name of the petitioner also appears along with his Twitter handle, whereas the petitioner has no such role in the entire scheme or in the fraudulent loss of money to the complainant.

4. Learned counsel for respondent No. 1, who appears on advance notice, on instructions, submits that the notice inadvertently mentions the name of the petitioner and that no action against the petitioner or his Twitter handle has been taken or is proposed to be taken. He further submits that, in fact, the Delhi Police is withdrawing the entire notice which was issued to Twitter under Section 94 of the BNSS and shall issue a fresh notice, if the need arises.

5. In view of the aforesaid submission, since the entire notice under

Section 94 of the BNSS is proposed to be withdrawn by Respondent No. 1, and also since the name of the petitioner is mentioned in the aforesaid notice inadvertently and no action is proposed to be taken against the petitioner, the relief sought by the petitioner stands satisfied.

6. The present petition is accordingly disposed of. Pending application(s), if any, also stand(s) disposed of.

7. The order be uploaded on the website forthwith. MADHU JAIN, J OCTOBER 6, 2026/b/yt
