1. The present petition has been filed seeking quashing of the FIR No.746/2020 dated 31st December, under Sections 498A/406/506/379/34 of Indian Penal Code, 1860 (‘IPC’) registered at Police Station Ambedkar Nagar, and the proceedings arising therefrom, on the basis of settlement.

2. Issue notice.

3. Notice is accepted by the APP appearing on behalf of the State and on behalf of the respondent no.2, who is present in-person.

4. The petitioner no.1 is the husband of the respondent no.2 and the petitioners no.2 and 3 are the family members of petitioner no.1.

5. The marriage of the petitioner no.1 and the respondent no.2 was solemnized on 25th June, 2017 as per Hindu rites and ceremonies.

6. Marital disputes arose between the petitioner no.1 and the respondent no.2, which resulted in filing of the present FIR on 31st December, 2020.

7. Now, the parties have settled their disputes in terms of the Memorandum of Understanding (‘MoU’) dated 19th July, 2024, which has been placed on record as Annexure-P-6 to the petition.

8. In terms of the MoU, the parties have been granted divorce by mutual consent under Section 13-B of the Hindu Marriage Act, 1955 and a decree of divorce dated 6th May, 2026 has been placed on record. A total sum of Rs.4,00,000/- was to be paid by the petitioners to the respondent no.2, which has been paid to the respondent no.2.

9. The respondent no.2 is present through video conferencing and has been identified by her counsel as well as the Investigating Officer (‘IO’). She informs the Court that she has settled the matter of her own free will and without any coercion. She further states that she has no objection to quashing of the present FIR.

10. The petitioners are present in Court and have been identified by their counsel. They affirm the statement of the respondent no.2 and undertake to abide by the terms of settlement arrived at between the parties.

11. Considering the above settlement between the parties, no useful purpose would be served by continuing with the proceedings of the present FIR and it would an unnecessary burden on the State exchequer. Hence, it would be in the interest of justice to quash the present FIR and the proceedings pursuant thereto.

12. Consequently, the FIR bearing No.746/2020, registered at Police Station Ambedkar Nagar and the proceedings pursuant thereto are quashed.

13. The petition stands disposed of. AMIT BANSAL, J OCTOBER 6, 2026 Vivek/-
