1. This hearing has been done through hybrid mode.

2. By way of the present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), the petitioners are seeking quashing of FIR No. 0843/2021, registered at Police Station Dwarka, New Delhi, for the offences punishable under Sections 406, 498A, and 34 of the Indian Penal Code,1860 (hereinafter referred to as the ‘IPC’), along with all consequential proceedings arising therefrom, on the basis of an amicable settlement arrived at between the parties.

3. Issue Notice. Learned APP for the State accepts notice on behalf of the State.

4. The Petitioners and Respondent No.2 are present before this Court and have been identified by the Investigating Officer (IO) concerned.

5. Briefly stated, Petitioner No.1 and Respondent No.2 were married according to Hindu rites and ceremonies on 26.02.2020 at Delhi, and no child was born out of the wedlock. Due to matrimonial differences, the parties started living separately w.e.f. 18.05.2021. Pursuant to a complaint made by Respondent No.2, FIR No.843/2021 was registered at P.S. Dwarka under Sections 406, 498A, and 34 of the IPC. Respondent No.2 also instituted proceedings under Section 12 of the Domestic Violence Act. During the pendency of the proceedings, the parties amicably settled their disputes before the Mediation Centre, Tis Hazari Courts, vide settlement agreement dated 01.03.2025, under which Petitioner No.1 agreed to pay Rs.5,00,000/- along with the agreed articles towards full and final settlement of Respondent No.2’s claims. The first two instalments of Rs.1,00,000/- and Rs.1,50,000/- have already been received by Respondent No.2.

6. The parties thereafter obtained divorce by mutual consent, with the first motion being allowed on 22.08.2025 and the second motion being allowed on 09.02.2026. In view of the settlement and dissolution of the marriage, the Petitioners seek quashing of FIR No.843/2021 and the consequential proceedings on the ground that continuation of the criminal proceedings would serve no useful purpose and would amount to an abuse of the process of law.

7. Learned counsel for the petitioners submits that, out of the balance settlement amount of Rs.2,50,000/-, a sum of Rs.30,000/- was handed over in cash to Respondent No.2 on the last date of hearing, while the remaining amount of Rs.2,20,000/- has been handed over to Respondent No.2 today in Court by way of Demand Draft bearing No. 656485. He further submits that, with the aforesaid payment, the settlement has been fully complied with and no amount remains outstanding thereunder.

8. On a query made by this Court, Respondent No.2, who has been duly identified by the IO, categorically states that she has entered into the settlement of her own free will, without any force, coercion or undue influence. She further states that the entire settled amount has been received by her and that she has no surviving claim whatsoever against the Petitioners. She has no objection if the present FIR and all proceedings emanating therefrom are quashed.

9. In view of the fact that the parties have amicably resolved all their disputes, the marriage already stands dissolved by a decree of divorce by mutual consent, the entire settlement amount has been paid, and Respondent No.2 has no objection to the quashing of the FIR, no useful purpose would be served in continuing the criminal proceedings. Rather, continuation thereof would only perpetuate unnecessary litigation between the parties. There is no legal impediment to quashing the FIR in the facts and circumstances of the present case.

10. Accordingly, FIR No. 0843/2021, registered at Police Station Dwarka, New Delhi, for the offences punishable under Sections 498A, 406, and 34 of the IPC, and all consequential proceedings emanating therefrom, are hereby quashed.

11. The present petition, along with pending application(s), if any, stands disposed of.

12. Copy of the order be communicated to the concerned learned Trial Court for necessary action and compliance.

13. The order be uploaded on the website forthwith.
