executing the settlement agreement and promising to repay the amount of Rs. 70 lakhs through 14 post-dated cheques. He states however as all these 14 cheques have been dishonoured on presentation.

3.2. He states that Look Out Circular [‘LOC’] issued against the petitioner was also revoked on the basis of the settlement and taking advantage of the revocation of the LOC, the petitioner has flown out of India.

3.3. He states that therefore respondent no. 2 has been defrauded yet again by the petitioner.

3.4. He therefore submits that respondent no. 2 is no more bound by the settlement agreement between the parties and the affidavit dated 16.10.2025 filed in support of the prayer sought in this petition.

4. Learned counsel for the petitioner does not dispute the submission of respondent no. 2 that the 14 cheques stand dishonour.

5. In view of the submission made by the learned counsel for respondent no. 2, this Court finds substance in the submission of respondent no. 2 that it cannot be held bound by the settlement.

6. The request for permission to withdraw this petition is therefore rejected.

7. The petition is dismissed.

8. Pending application stands disposed of.
