1. The petitioners have filed this writ petition with as many as 23 prayers, predominately directed against a recruitment notice dated 09.12.2025, further notifications upto dated 10.09.2026, and Rule 7.3(iv)(c) of the National Highways and Infrastructure Development Corporation Limited [“NHIDCL”] (Recruitment, Seniority and Promotion) Rules, 2025 issued by respondent No. 2 - NHIDCL. 2. The synopsis and the writ petition are replete with averments to the effect that the petitioners are not directly affected by the actions of the NHIDCL, but have approached this Court “purely in public interest” [paragraph 7 of the writ petition].

3. In this view of the matter, Mr. Devdutt Kamat, learned Senior Counsel for the petitioners, seeks permission to withdraw this writ petition, without prejudice to the petitioners’ right to file a properly constituted Public Interest Litigation [“PIL”], after complying with all the formalities required under the rules of this Court.

4. Mr. Rajshekhar Rao, learned Senior Counsel for NHIDCL, however, submits that no PIL would be maintainable in circumstances of this nature, arising out of a purely service related dispute.

5. Having regard to the request of Mr. Kamat, the writ petition, alongwith pending applications, is dismissed as withdrawn, in terms of his submission.

6. Naturally, all questions of maintainability or merits of any subsequent petition filed by the petitioners, are left open, to be decided by the roster Bench dealing with the petition.
