05.10.2026 CM APPL. 68388/2026 (Exemption) in W.P.(C) 14619/2026 CM APPL. 68825/2026 (Exemption) in W.P.(C) 14713/2026 Exemptions allowed, subject to all just exceptions. The applications stand disposed of. W.P.(C) 14619/2026 & W.P.(C) 14713/2026

1. By way of the present petitions under Article 226 of the Constitution, the petitioners, both of whom have retired from the service of respondent No. 3 – Air Force School [“School”], seek release of pension computed at 50% of their last drawn salary as on their respective dates of superannuation. They have, in this regard, submitted representations to respondent No. 1 – Directorate of Education [“DoE”], seeking appropriate directions to the School.

2. Issue notice. Ms. Jyoti Tyagi, learned counsel, accepts notice on behalf of respondent Nos. 1 and 2.

3. Ms. Tyagi, on instructions, submits that the said representations shall be considered and decided within a period of three months from today, after notice to the School, if necessary.

4. In view of the aforesaid submission, the petitions are disposed of with a direction to the DoE to take a decision on the representations of the petitioners within the aforesaid period.

5. It is clarified that this Court has not expressed any opinion on the merits of the petitioners’ claim for pension, including on the applicability of Section 10 of the Delhi School Education Act, 1973. All contentions in this regard are left open for consideration by the DoE. Since notice has not been issued to respondent No. 3 – School in the present proceedings, its rights and contentions are also expressly left open.

6. In the event the decision is adverse to the petitioners, it shall be open to them to avail of such remedies as may be available in accordance with law. PRATEEK JALAN, J OCTOBER 5, 2026 ‘pv’/SD/
