CRL.REV.P.(MAT.) 476/2026

4. Having considered the petitioner’s verified arrears and his necessary financial obligations, this Court is of the view that recovery at the rate of Rs. 10,000/- per month would appropriately balance the payment of current maintenance with the recovery of the accumulated dues. The attachment is, accordingly, modified to Rs. 10,000/- per month, of which Rs. 8,000/- shall be appropriated towards current maintenance and Rs. 2,000/- towards the arrears.

5. All payments already made shall be duly accounted for and given due credit upon verification by the Executing Court.

6. Learned counsel for the petitioner, on instructions, unequivocally undertakes to ensure payment of Rs.10,000/- per month in the manner directed above till the arrears are cleared and thereafter, to continue to pay the current maintenance under the subsisting order.

7. It is also undertaken that any interruption in salary deduction shall not excuse payment and that he shall arrange direct payment even in such a scenario.

8. The aforesaid undertakings are accepted and taken on record. The petitioner shall remain bound therewith.

9. The petition is disposed of in the above terms. Pending applications also stand disposed of.
