1. This hearing has been done through hybrid mode.

2. The present petition has been filed under Article 226 of the Constitution of India read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’) seeking the following reliefs: “a) Issue an appropriate Writ, Order and/or Direction in the nature of Mandamus directing Respondent No. 2, i.e. the Director, Forensic Science Laboratory, Rohini, Delhi, to forthwith submit/furnish the pending FSL Report, particularly the report pertaining to the CCTV footage/material sent to the FSL, in respect of SC No. 506/2024 arising out of FIR No. 181/2024, P.S. Jama Masjid, Delhi, under Section 376D IPC, before the Ld. Trial Court, within such time-bound period as may be fixed by this Hon’ble Court; b) Direct the Respondent No.1/concerned Investigating Officer to take all necessary and effective steps for obtaining and placing the pending FSL Report before the Ld. Trial Court immediately upon its receipt, so that the further proceedings in the trial are not delayed on account of the said report;

c) Direct the Ld. Trial Court to thereafter proceed with the matter expeditiously, and endeavour to complete the examination and cross-examination of the remaining material witnesses and conclude the trial at the earliest, without granting avoidable adjournments on account of the pendency of the FSL report;

d) Pass any other or further Writ, Order and/or Direction which this Hon’ble Court may deem just, fit and proper in the facts and circumstances of the present case and in the interest of justice.”

3. Learned counsel for the petitioner submits that the trial is being delayed as the FSL Report is still awaited. It has been more than an year and learned Trial Court has even issued show-cause notice to the FSL Director, Rohini but neither he appeared in consequence to the show-cause notice nor the FSL Report has been received.

4. Learned APP for the State who appears on advance notice also submits that directions for expeditious submissions of the FSL Report be made in the facts and circumstances of the case. Since the trial is getting delayed, the Director FSL, Rohini is directed to furnish the pending FSL Report in the present case in respect of SC No. 506/2024 arising out of FIR No.0181/2024 registered at Police Station Jama Masjid, Delhi for the offences punishable under Section 376(D) of Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), preferably within a period of 6 months from the date of receipt of this order.

5. With these directions, the present petition is disposed of. Pending application(s), if any, also stand(s) disposed of.

6. The order be uploaded on the website forthwith. MADHU JAIN, J OCTOBER 1, 2026/b/yt
