1. This hearing has been conducted through hybrid mode.

2. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [hereinafter referred to as ‘BNSS’], seeking quashing of FIR No. 506/2019 dated 14.09.2019, registered at Police Station Kalkaji, South-East District, Delhi, under Sections 406, 420, 468, 471 and 120B of the Indian Penal Code, 1860 [hereinafter referred to as ‘IPC’], and all proceedings emanating therefrom, on the basis of a Settlement Agreement dated 30.11.2023 executed between Petitioner No. 1 and Respondent No. 2.

3. Issue notice. The learned APP for the State accepts notice on behalf of the State.

4. The petitioner and respondents no. 2 have appeared before this Court through video conferencing [VC] and have been duly identified by their respective learned counsel and the concerned Investigating Officer [IO] .

5. Briefly stated, the dispute arose between Petitioner No. 1, a private limited company, and Respondent No. 2, its former employee, concerning allegations relating to forged/unaccounted invoices and commission claims. Both parties instituted separate proceedings under Section 156(3) Cr.P.C., whereupon the learned Magistrate, vide a common order dated 12.09.2019, directed registration of an FIR taking into account the rival allegations, pursuant to which the present FIR came to be registered. Subsequently, the parties entered into a Settlement Agreement dated 30.11.2023, in terms whereof the connected civil and criminal proceedings between them have been withdrawn/compounded.

6. On a query made by this Court, Respondent No. 2, who has been duly identified by the concerned Investigating Officer [IO], states that he entered into the Settlement Agreement dated 30.11.2023 of his own free will and without any pressure, coercion, undue influence or threat. He further states that he has no objection if the aforementioned FIR and all proceedings emanating therefrom are quashed.

7. In view of the above, considering the nature of the dispute and the fact that the parties have amicably resolved their differences of their own free will and without any pressure, coercion, undue influence or threat, no useful purpose would be served by continuing the proceedings. Rather, continuation thereof may only give rise to further acrimony between the parties. In these circumstances, this Court is of the view that the interest of justice would be served by bringing the proceedings to an end. Accordingly, the aforesaid FIR and all proceedings arising therefrom are liable to be quashed.

8. Accordingly, FIR No. 506/2019 dated 14.09.2019, registered at Police Station Kalkaji, South-East District, Delhi, under Sections 406, 420, 468, 471 and 120B IPC along with all consequential proceedings emanating therefrom, is hereby quashed.

9. Therefore, the present petition is allowed and accordingly, disposed of.

10. The pending application also stands disposed of.

11. A copy of this order be sent to the concerned learned Trial Court for necessary information and compliance.

12. The order be uploaded on the website forthwith. MADHU JAIN, J OCTOBER 1, 2026/b/PG
