2. Allowed subject to all just exceptions.

3. The applications are disposed of. CRL.M.C. 7387/2026

4. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the “BNSS”), seeking quashing of FIR No. 476/2023, registered at P.S. Jaitpur, Delhi, under Sections 498A/406/34/354 of the Indian Penal Code, 1860 (hereinafter referred to as the “IPC”), along with all consequential proceedings emanating therefrom, on the basis of an amicable settlement arrived at between the parties.

5. Issue notice.

6. Learned APP for the State and learned counsel for Respondent No. 2 accept notice on behalf of the respective respondents.

7. The Petitioners and Respondent No. 2 are present before this Court. Respondent no.2 has been duly identified by her counsel as well as the Investigating Officer (IO) concerned.

8. Briefly stated, the marriage between Petitioner No. 1 and Respondent No. 2 was solemnized on 05.10.2022 in accordance with Hindu rites and ceremonies. No child was born out of the said wedlock. Owing to matrimonial differences, the parties started residing separately with effect from 21/02/2023. Thereafter, Respondent No. 2 lodged the present FIR against the Petitioners. During the pendency of the proceedings, the parties amicably resolved their disputes before the Counselling Cell, Family Court, South-East, Saket Courts, New Delhi, and executed a Settlement Agreement dated 22.05.2025. Pursuant to the settlement, the parties also initiated and completed proceedings for dissolution of their marriage by mutual consent. The marriage between Petitioner No. 1 and Respondent No. 2 was accordingly dissolved by a decree of divorce by mutual consent.

9. Learned counsel for the Petitioners submits that, in terms of the Settlement Agreement dated 22.05.2025, the parties agreed to settle all their disputes for a total sum of Rs. 9,07,000/-. He submits that the balance amount of Rs. 4,07,000/- (Rupees Four Lakhs Seven Thousand only) has been handed over to Respondent No. 2 today in Court by way of Demand Draft bearing No. 272662. It is submitted that, upon payment of the aforesaid amount, the terms and conditions of the settlement stand fully complied with and nothing further remains to be paid by the Petitioners to Respondent No. 2 under the settlement.

10. On a query made by the Court, Respondent No. 2, who has been duly identified by the IO, states that she has entered into the settlement of her own free will and without any force, coercion or undue influence. She further states that she has received the entire settled amount, including the aforesaid balance amount of Rs. 4,07,000/-, and that she has no surviving claim whatsoever against the Petitioners. She has no objection to the quashing of the present FIR and all proceedings emanating therefrom.

11. In view of the fact that the parties have amicably resolved all their disputes, the marriage between Petitioner No. 1 and Respondent No. 2 stands dissolved by a decree of divorce by mutual consent, the settlement amount has been paid in full and Respondent No. 2 has no objection to the quashing of the FIR, no useful purpose would be served by continuing the criminal proceedings. Continuation of the proceedings would only serve to prolong the litigation between the parties.

12. Accordingly, FIR No. 476/2023, registered at P.S. Jaitpur, Delhi, for the offences punishable under Sections 498A/406/34/354 of the IPC, and all consequential proceedings emanating therefrom, are hereby quashed.

13. The present petition stands disposed of. Pending application(s), if any, also stand(s) disposed of.

14. Copy of the order be communicated to the concerned learned Trial Court for necessary action and compliance.

15. The order be uploaded on the website forthwith. MADHU JAIN, J OCTOBER 1, 2026/b/P
