1. This hearing has been done through hybrid mode. CRL.M.A. 30999/2026 (Exemption)
2. Allowed subject to all just exceptions.
3. The application is disposed of. CRL.M.C. 7410/2026
4. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), seeking quashing of FIR No. 584/2018, registered at P.S. Prashant Vihar, Delhi, under Sections 498A/406/34 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), along with all consequential proceedings arising therefrom, on the basis of the settlement arrived at between the parties.
5. Issue notice.
6. Learned APP for the State accepts notice.
7. The Petitioner and Respondent No. 2 are present in Court and have been identified by their respective counsel as well as by the Investigating Officer (IO) concerned.
8. Briefly stated, the marriage between the Petitioner and Respondent No. 2 was solemnized on 18.02.2002 in accordance with Hindu rites and ceremonies. Out of the said wedlock, two daughters, namely, Deepanshi Bansal and Shubhangi Bansal, were born. The parties have been residing separately since 01.05.2020. Thereafter, Respondent No. 2 lodged the present FIR against the Petitioner and his family members. During the pendency of the proceedings, the parties amicably resolved their disputes and executed a Memorandum of Understanding dated 12.05.2026. Pursuant thereto, the parties initiated proceedings for divorce by mutual consent and the marriage was dissolved by a decree of divorce by mutual consent vide judgment/decree dated 25.07.2026 passed by the learned Principal Judge, Family Court, North District, Rohini Courts, Delhi.
9. Learned counsel for the Petitioner submits that, in terms of the settlement between the parties, all their disputes have been amicably resolved. It is further submitted that the balance amount of Rs.4,00,000/- (Rupees Four Lakhs only) has been handed over to Respondent No. 2 today in Court by way of Demand Draft bearing No. 515951. It is submitted that, upon the aforesaid payment, the terms of the settlement stand fully complied with and nothing further remains to be paid by the Petitioner under the settlement.
10. On a query made by this Court, Respondent No. 2, who has been duly identified by the IO, states that she has entered into the settlement with the Petitioner voluntarily and of her own free will, without any force, coercion or undue influence. She further states that she has received the entire settled amount and has no surviving claim against the Petitioner. She has no objection if the present FIR and all consequential proceedings arising therefrom are quashed. The affidavit of Respondent No. 2 also records that the parties have settled their dispute and that she has no objection to the quashing of FIR No. 584/2018.
11. In view of the fact that the parties have amicably resolved their disputes, their marriage already stands dissolved by a decree of divorce by mutual consent, the settlement terms have been complied with and Respondent No. 2 has no objection to the quashing of the FIR, no useful purpose would be served in permitting the criminal proceedings to continue. Continuation of the proceedings would only result in further litigation between the parties.
12. Accordingly, FIR No. 584/2018, registered at P.S. Prashant Vihar, Delhi, under Sections 498A/406/34 of the IPC, and all consequential proceedings emanating therefrom, are hereby quashed.
13. The present petition stands disposed of. Pending applications, if any, stand disposed of.
14. Copy of the order be communicated to the concerned learned Trial Court for necessary action and compliance.
15. The order be uploaded on the website forthwith. MADHU JAIN, J OCTOBER 1, 2026/b/P
