1. This hearing has been done through hybrid mode.

2. By the way of the present petition, filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘BNSS’) the petitioner is seeking quashing of FIR No. 477/2022, registered at Police Station Kirti Nagar, Delhi, for the offences punishable under Sections 452, 308 and 34 Indian Penal Code,1860 (hereinafter referred to as the ‘IPC’), and all consequential proceedings emanating therefrom on the basis of the settlement arrived at between the parties.

3. Issue notice. The learned APP accepts notice on behalf of the State.

4. The petitioner and respondent no. 2 are present before this Court and have been identified by their counsel and the Investigating Officer.

5. The FIR was registered pursuant to a complaint made by Respondent No. 2 arising out of a dispute between the petitioners and Respondent Nos. 2 to 4 on 07.10.2022. Upon completion of investigation, the charge-sheet was filed before the learned Additional Sessions Judge, West, Tis Hazari Courts, Delhi, on 18.05.2023, and the matter is presently pending at the stage of evidence.

6. During the pendency of the proceedings, the parties amicably resolved their disputes and executed a Settlement Deed dated 11.02.2025. As per the terms of the settlement, a sum of ₹30,000/- has been paid by the petitioners to the concerned respondent towards settlement of the dispute. Pursuant to the settlement, Respondent Nos. 2 to 4 have expressed their unwillingness to pursue the criminal proceedings and have furnished their no-objection affidavits for quashing of the FIR. In view of the settlement and the parties having resolved their disputes, the petitioners seek quashing of the FIR and the consequential proceedings arising therefrom.

7. On a query made by this Court, respondent no. 2, who has been identified by the IO, has categorically stated that she has entered into compromise, vide Settlement Agreements dated 11.02.2025, of his own free will and without any pressure, coercion or threat. Therefore, she has no objection if the present FIR is quashed.

8. In view of the above, the parties have amicably resolved their differences of their own free will, and without any coercion; no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

9. Accordingly, FIR No. 477/2022, registered at Police Station Kirti Nagar, Delhi, for the offences punishable under Sections 308, 452, and 34 of the IPC, 1860, along with all consequential proceedings emanating therefrom, is hereby quashed.

10. The present petition is disposed of. Pending application(s), if any, also stand(s) disposed of.

11. Copy of the order be communicated to the concerned Trial Court for necessary action and compliance.

12. The order be uploaded on the website forthwith. MADHU JAIN, J OCTOBER 1, 2026/b/yt
