1. By way of the present petition under Article 226 of the Constitution, the petitioner, who is the intending purchaser of an immovable property, being land measuring 01-Bigha & 15-Biswa, out of Khasra No.79//6 min. (1-15), situated in the revenue estate of village Kanjhawala, Delhi-110081, [hereinafter, “subject property”], seeks directions upon the Government of National Capital Territory of Delhi [“GNCTD”] to register a Sale Deed dated 04.08.2026 executed in her favour, pursuant to her purchase of the subject property from respondent No. 4, attorney holder of respondent No. 5, the present owner.

2. The case of the petitioner is that the registration of the aforesaid Sale Deed has been refused on the ground that consolidation proceedings in respect of the subject property are still pending and that the petitioner has not furnished a No Objection Certificate [“NOC”] and/or Land Status Report [“LSR”].

3. Ms. Surbhi Dewan, learned counsel for the petitioner, submits that the only impediment to the grant of NOC/LSR is the pendency of the consolidation proceedings in respect of Village Kanjhawala. She further relies upon the orders passed by this Court in Okaya Infocom Pvt. Ltd. and Anr. v. Govt. of NCT of Delhi and Anr.1, Smt. Nirmala Devi and Ors. v. Govt. of NCT of Delhi & Anr. and connected matter2, and several subsequent orders3, as well as the Circular dated 14.08.2025 issued by the GNCTD, whereby the procedure for registration of land documents has been streamlined, and registration has been permitted subject to the purchaser undertaking to abide by the outcome of the pending consolidation proceedings.

4. Ms. Dewan further submits that the petitioner is agreeable to purchasing the subject property on the aforesaid terms and undertakes to abide by the outcome of the pending consolidation proceedings, without prejudice to the rights and contentions of any third party.

5. It is also noted that the Sale Deed records that the subject property is not under any acquisition proceedings.

6. In view of the aforesaid, the present writ petition, alongwith the pending application, is disposed of with a direction that the registration of the Sale Deed in question shall not be refused merely on account of non- availability of the NOC/LSR. 1 W.P.(C) 12122/2021, decided on 10.11.2023. 2 W.P.(C) 4046/2025, decided on 01.04.2025. 3 Chandan Sawhney v. State (NCT of Delhi) [2024 SCC OnLine Del 8421]; and Vinod Kumar Rajoria v. Government of NCT of Delhi and Others, [2023 SCC OnLine Del 5446].

7. The petitioner will, however, file an undertaking before the Revenue Authority to the effect that she is taking the subject property, subject to the result of the consolidation proceedings, and without prejudice to the rights and contentions of any third-party.
