1. This hearing has been done through hybrid mode.
2. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), seeking quashing of FIR No. 311/2023, registered at Police Station Nihal Vihar, New Delhi, for the commission of offences punishable under Sections 406, 498A and 34 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), and all consequential proceedings emanating therefrom.
3. Issue Notice.
4. Learned APP for the State as well as learned counsel for respondent no.2 accept notice.
5. Petitioner Nos. 1 to 3 and Respondent No. 2 are present before this Court and have been duly identified by their respective counsel and the Investigating Officer concerned.
6. Brief facts of the case are that Petitioner No. 1 married Respondent No. 2 as per Hindu rites and ceremonies on 07.07.2018. Due to temperamental and matrimonial differences, the aforesaid FIR came to be registered. Learned counsel for the Petitioners and Respondent No. 2 submit that the parties have amicably resolved all their matrimonial disputes and have been residing together along with their minor child.
7. It is submitted that nothing further survives between the parties. On a query made by this Court, Respondent No. 2 categorically states that she has entered into the settlement out of her own free will, without any force, coercion or undue influence before the Delhi Mediation Centre, Tis Hazari Courts, Delhi vide settlement dated 15.01.2024. She further states that she has been residing with Petitioner No. 1 since 2024 and has no objection if the present FIR and all consequential proceedings arising therefrom are quashed. The settlement records that the parties had decided to resume cohabitation along with their child at the matrimonial home with effect from 26.01.2024.
8. In view of the fact that the parties have amicably resolved their matrimonial disputes, resumed cohabitation and have been living together, no useful purpose would be served by continuing the criminal proceedings. Rather, continuation thereof would only result in unnecessary litigation between the parties. There is no legal impediment to quashing the FIR in the facts and circumstances of the present case.
9. Accordingly, FIR No. 311/2023, registered at Police Station Nihal Vihar, New Delhi, under Sections 406, 498A and 34 IPC, and all consequential proceedings emanating therefrom, are hereby quashed.
10. The present petition stands disposed of along with the pending application(s), if any.
11. A copy of this order be communicated to the concerned Trial Court for necessary action and compliance.
12. The order be uploaded on the website forthwith. MADHU JAIN, J SEPTEMBER 30, 2026/b/m
