1. The present appeal is filed by the appellant (respondent therein) under Clause X of the Letters Patent read with Section 10 of the Delhi High Court Act, 1966 challenging the ex-parte stay order dated 24.08.2026 granted by the learned Single Judge in CM APPL.55994/2026 in W.P.(C) No.5313/2025.

2. At the very outset, learned counsel appearing on behalf of the respondent raises a preliminary objection that appellant has remedy of filing an application for stay vacation before the learned Single Judge instead of filing the present appeal. The said application can be decided by the learned Single Judge only who had granted the ex-parte stay. This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 05/10/2026 at 10:47:32

3. Amongst the other submission, learned counsel appearing on behalf of the appellant submits that the said writ petition is not maintainable without going into the merits of the case.

4. We agree with the submissions made by the learned counsel appearing on behalf of the respondent. Let a stay vacation application be filed by the appellant before the learned Single Judge who shall hear and decide the same as expeditiously as possible without granting any unnecessary adjournments.

5. With these observations, the appeal stands disposed of. Pending applications also stand disposed of.
