1. The present applications seek regular bail in FIR No. 537/2020 registered at P.S. Alipur under Sections 302/34 of the Indian Penal Code, 1860. Charges were framed on 24th March, 2023 and the prosecution has cited 23 witnesses, out of whom only 6 witnesses have been examined so far. Both Applicants have remained in custody since 10th November, 2020 and the trial is yet to conclude.

2. Noting that the trial was being prolonged, this Court, had called for the Trial Court Record to ascertain whether the delay was attributable to the conduct of the Applicants or was occasioned for other reasons. The report has been received. It is noted that, on certain occasions, the delay has been occasioned on account of the Applicants.

3. In the aforesaid circumstances, counsel for the Applicants, after making submissions for some time, seek permission to withdraw the applications, with a request that the Trial Court be directed to expedite the trial.

4. Considering the substantial period of custody undergone by the Applicants and the fact that the trial has not progressed at the desired pace, the Trial Court is requested to expedite the trial and endeavour to conclude the trial within a period of nine months from today.

5. The Trial Court shall not grant unnecessary adjournments to either side. The Applicants shall extend full cooperation in the conduct of the trial and shall not seek any adjournment.

6. In case the trial is not concluded within the aforesaid period, the Applicants shall be at liberty to renew their request for bail.

7. The applications are dismissed as withdrawn.

8. Copy of the order be sent to the Trial Court, for necessary information and compliance.
