1. The present petition has been filed seeking issuance of directions to Respondent No. 1- 4 to decide the Petitioner’s complaint dated 28.07.2026 and conduct a fact-finding inquiry into the allegations raised in the complaint concerning declaration of Respondent No.6 as the husband/family member/dependant of Respondent No. 5 in CGHS records.

2. It is the case of the Petitioner that she is the legally wedded wife of the Respondent No. 6/Sh. Ajay Kumar and their marriage was solemnized on 27.01.1991 which continues to subsist. The Respondent No. 5/Smt. Shashi Rani is allegedly working as an ANS at Safdarjung Hospital and the Petitioner has come across certain documents (Aadhar Card of Respondent No. 5 and CGHS Documents) This is a digitally signed order. which show that Respondent No. 6 has been reflected as the husband of the Respondent No. 5. This led to the petitioner giving a complaint dated 28.07.2026 requesting verification of the documents/relevant service records/family declarations/nomination forms/CGHS records etc. She has further served a legal notice dated 20.08.2026 to the concerned Respondents, however, till date no response has been received.

3. The record reflects that the basis of the Petitioner’s complaint is the allegation that during the subsistence of marriage, the Respondent No. 5 has developed an illicit affair with the Respondent No. 6 and he may be availing CGHS/Government benefits illegally.

4. Writ courts cannot be a forum for determination of any private matrimonial disputes or for settling personal scores or seeking declarations on marital statuses, where no public law element is involved.

5. In view of the same, the concerned Authorities are at liberty to take appropriate action on the complaint(s) filed by the Petitioner in accordance with law/extant rule.

6. Needless to say, the Petitioner is at liberty to avail appropriate legal remedies against Respondent Nos. 5 and 6.

7. The petition, along with the pending application(s) also stands disposed of. AMIT MAHAJAN, J SEPTEMBER 30, 2026 DU This is a digitally signed order.
