1. This hearing has been conducted through hybrid mode.

2. The present application has been filed by the Applicant/Accused under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [hereinafter, referred to as ‘BNSS’] in FIR No. 178/25, registered at Police Station Uttam Nagar, District Dwarka, Delhi under Sections 143(4), 61(2), 111, 238(b) and 3(5) Bharatiya Nyaya Sanhita, 2023 [hereinafter, referred to as ‘BNS’] & Section 81 of the Juvenile Justice [care and protection of children] Act, 2015 [hereinafter, referred to as ‘JJ Act’].

3. Learned counsel for the petitioner submits that the petitioner was merely present with the co-accused persons and that no recovery was effected from her. It is further submitted that she has no connection with the other co- accused persons. Learned counsel submits that, though one other criminal case was registered against the petitioner, she already stands discharged in the said case. It is further submitted that the co-accused, namely Jitender and Yasmin, have already been enlarged on bail by the learned Trial Court and, therefore, the petitioner seeks bail on the ground of parity

4. Per contra, learned APP for the State opposes the present application and submits that the petitioner was apprehended at the spot. It is submitted that the co-accused, Jitender and Yasmin, had come to deliver the child, whereas the petitioner had come to receive the child and was thereafter to facilitate the sale of the child. Learned APP further submits that the chats placed on record disclose the petitioner’s connection with the other co- accused persons and her involvement in the alleged transaction. It is, therefore, submitted that, having regard to the gravity of the allegations and the role attributed to the petitioner, she is not entitled to be released on bail. It is further submitted that the grant of bail to the other co-accused persons would not, by itself, entitle the petitioner to bail on the ground of parity, particularly when the role attributed to her is stated to be distinct.

5. Heard both the parties and perused the material placed on record.

6. As per the case of the prosecution, the petitioner had come to the spot to receive the child from the co-accused persons, namely Jitender and Yasmin, for the purpose of thereafter facilitating the sale of the child. A further perusal of the record shows that there are chats which clearly connect the petitioner with the other co accused persons.

7. Accordingly, no ground for bail is made out.

8. Therefore, the present bail application is dismissed and thereby disposed of.

9. Pending application[s] if any, also stand[s] disposed of.

10. A copy of this order be sent to the concerned learned Trial Court for necessary information and compliance.

11. The order be uploaded on the website forthwith. MADHU JAIN, J SEPTEMBER 30, 2026/Ni/PG
