1. This hearing has been conducted through hybrid mode.
2. At the outset, learned Counsel for the appellant submitted that the present appeal has inadvertently been filed as an RFA, whereas the appropriate remedy against the impugned order is by way of an FAO. He therefore, seeks permission to withdraw the present appeal with liberty to avail of the appropriate remedies, in accordance with law. He also seeks refund of the court fee.
3. Keeping in view the submissions made by learned Counsel for the appellant, the present appeal is disposed of as withdrawn, with liberty to the appellant to avail of appropriate remedies, in accordance with law.
