28.09.2026 CM APPL. 66871/2026 (for exemption)
1. Allowed, subject to all just exceptions.
2. The application stands disposed of. CONT.CAS(C) 1798/2026
3. The present contempt petition has been filed under Section 10 r/w Section 12 of the Contempt of Courts Act, 1971 stating that the Respondent is in wilful, deliberate and contumacious disobedience of directions issued in the order dated 29.04.2026 passed by the coordinate Bench of this Court in CRL.REV. P. 1018/2024.
4. Learned counsel for the Petitioner states that the Respondent was directed by the trial court vide order dated 29.05.2024 to pay interim maintenance of Rs. 1 lakh per month to the wife and Rs. 15,000/- to the minor child. He states that the Respondent impugned the said order in CRL.REV. P. 1018/2024 wherein a conditional stay was granted by High
Court in his favour on 02.04.2025. He states that, however, during the pendency of the proceedings the arrears mounted and, in these circumstances, on 29.04.2026, the coordinate Bench of this Court directed the Respondent to deposit an amount of Rs. 10 lakhs within the time limits mentioned in para 2 of the said order. 4.1 He states that the Respondent has not complied with the said order and therefore, this petition has been filed. 4.2 He states that the Petitioner herein has separately initiated execution proceedings before the trial court for the execution of the order dated 29.05.2024.
5. This Court has considered the submissions of the Petitioner.
6. This Court notes that the coordinate Bench while hearing CRL.REV. P. 1018/2024 after taking note of the wilful, non-compliance of the Respondent vide order dated 16.07.2026 has vacated the stay order dated 02.04.2025. Thereafter, the Petitioner herein has approached the trial court for execution of the order dated 29.05.2024, and rightly so.
7. In the considered opinion of this Court, the consequence of the Respondent’s non-compliance of the order dated 29.04.2026 has been addressed by the coordinate Bench by passing the subsequent order dated 16.07.2026 of vacating the conditional stay order dated 02.04.2025.
8. This Court is therefore not inclined to entertain this contempt petition for non-compliance of the order dated 29.04.2026, however, the conduct of the Respondent in not complying with the directions in the orders of the
High Court will be duly considered while hearing and deciding the CRL.REV. P. 1018/2024, which is already listed on 30.10.2026.
9. With the aforesaid directions, this petition is disposed of.
