1. The present petition has been filed under Article 227 of the Constitution of India, 1950 (“Constitution”), read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (“BNSS”), seeking quashing of the First Information Report (“FIR”) being FIR No. 66/2024 dated 17th February, 2024, registered at Police Station (“PS”) Chitranjan Park, South District, Delhi, under Section 420 of the Indian Penal Code, 1860 (“IPC”), along with subsequent proceedings arising therefrom.

2. Issue notice. Notice is accepted by learned Additional Standing

Counsel (“ASC”) appearing for the State, i.e., respondent no. 1, as well as by learned counsel appearing for respondent no. 2, who is present before this Court.

3. As per FIR No. 66/2024, respondent no. 2 alleged, inter alia, that the petitioner had committed cheating by making false representations and assurances to induce him to enter into an agreement to sell for a property she claimed to own, for which he had paid an advance amount of Rs. 5,00,000/-. It was further alleged that the petitioner had forged documents in relation to the title of the property.

4. Learned counsel appearing for the petitioner submits that the petitioner and respondent no. 2 have settled their dispute by executing a Settlement Deed dated 20th February, 2026, whereby the petitioner agreed to pay respondent no. 2 a total sum of Rs. 15,50,000/- towards full and final settlement of all his claims, including any expenses of litigation.

5. Learned counsel appearing for respondent no. 2 submits that respondent no. 2 does not wish to pursue the present matter any further.

6. He submits that respondent no. 2 has already received the requisite amount in terms of the aforesaid Settlement Deed, i.e., Rs. 15,50,000/-.

7. Learned counsel appearing for the petitioner submits that since the petitioner has already paid the said amount to respondent no. 2, the other litigations pending between the parties have been closed.

8. This Court is informed that there were four to five litigations pending between the parties, all of which have since been settled and withdrawn, except the proceedings arising out of FIR No. 66/2024, which remain pending.

9. Learned ASC appearing for the State submits that he has no objection if the present petition is allowed, since the charge against the petitioner under Section 420 of the IPC is compoundable in nature.

10. He, however, submits that cost should be imposed upon the petitioner.

11. Accordingly, considering the submissions made before this Court, it is directed that FIR No. 66/2024 dated 17th February, 2024, registered at PS Chitranjan Park, along with the consequential proceedings emanating therefrom, is hereby quashed.

12. However, considering the facts and circumstances of the case, it is directed that the petitioner shall pay a sum of Rs. 20,000/- as cost to the Delhi High Court Advocates Welfare Trust (‘A/c No. 15530210002995, Bank Name: UCO Bank, Branch Address: Delhi High Court, IFSC: UCBA0001553’).

13. Let the cost be paid, within a period ten days from today.

14. Proof of payment shall be filed before this Court.

15. The present petition, along with the pending application, is accordingly disposed of. MINI PUSHKARNA, J SEPTEMBER 28, 2026 ak
