1. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (‘BNSS’) seeking quashing of FIR No. 49/2017 dated 2nd March, 2017, registered at P.S. Najafgarh, Outer District, Delhi, under Sections 451/323/342/34 of the Indian Penal Code, 1860 (‘IPC’) and all proceedings arising therefrom, on the ground of settlement.

2. Issue notice.

3. Notice is accepted by the APP appearing on behalf of the State and the counsel appearing on behalf of respondent no. 2.

4. The respondent no.2 is the husband of the daughter of the petitioner no.1, and the petitioners no. 2 to 5 are the family members of the daughter of the petitioner no.1.

5. The marriage of the daughter of petitioner no. 1 and respondent no. 2 was solemnized on 5th February, 2016 as per Hindu rites and ceremonies. No child was born out of the wedlock.

6. Matrimonial disputes arose between the daughter of petitioner no. 1 and respondent no. 2, which resulted in filing of the present FIR on 2nd March, 2017, on the complaint of respondent no. 2.

7. Now, the parties have settled their disputes in terms of the Counselling Settlement dated 30th January, 2026, executed before the Counselling Cell, Family Courts, Dwarka Courts, New Delhi, which has been placed on record as Annexure P-1 to the petition.

8. In terms of the settlement, the parties have resolved their disputes and agreed to dissolve the marriage between the daughter of petitioner no. 1 and respondent no. 2 by way of mutual consent. Further, the respondent no. 2 has agreed to pay a sum of Rs. 25,00,000/- to the daughter of the petitioner no.1, in three tranches.

9. It is stated that the total of the aforesaid amount has been received by the daughter of the petitioner no. 1. The marriage stands dissolved vide divorce decree dated 07th April, 2026 passed in HMA No. 1066/2026.

10. The respondent no. 2 is present in Court and has been identified by his counsel as well as by the Investigating Officer (‘IO’). He informs the Court that he has settled the matter of his own free will and without any coercion. He further states that he has no objection to quashing of the present FIR.

11. The petitioners are also present in Court and have been identified by their counsel. They affirm the statement of the respondent no. 2 and undertake to abide by the terms of settlement arrived at between the parties.

12. Considering the above settlement between the parties, no useful purpose would be served by continuing with the proceedings of the present FIR and it would be an unnecessary burden on the State exchequer.

13. Hence, it would be in the interest of justice to quash the present FIR and the proceedings pursuant thereto.

14. Consequently, the FIR No. 49/2017, registered at P.S. Najafgarh, Outer District, Delhi and the proceedings pursuant thereto are quashed.

15. The petition stands disposed of.

16. The pending application stands disposed of. AMIT BANSAL, J SEPTEMBER 28, 2026 at
