1. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (“BNSS”), seeking quashing of the order dated 06th May, 2026, passed by the Additional Sessions Judge (FTC), South-West District, New Delhi, in CR 412/2025, wherein, there are directions to register a First Information Report (“FIR”) against the petitioners at Police Station (“PS”) Uttam Nagar, New Delhi.

2. Learned counsel appearing for the petitioners submits that the petitioners have settled the matter with respondent nos. 2 and 3.

3. Petitioner nos. 1 to 3 are present in person before this Court. They have profusely apologized for their conduct and submitted that they shall not indulge in such manhandling or other such conduct in future. They undertake before this Court that they shall lead a civilized life and shall be an asset to the society.

4. Respondent nos. 2 and 3 are also present in person before this Court, and they are identified by the concerned Investigating Officer (“IO”).

5. Respondent nos. 2 and 3 submit that they have settled the matter with the petitioners and do not wish to pursue the same any further.

6. This Court notes that a Deed of Settlement dated 08th June, 2026, has been executed between the petitioners and respondent nos. 2 and 3 herein, at Delhi, whereby, the parties have amicably decided, without any force, fraud or coercion to bring the ongoing dispute between them to an end.

7. The petitioners have undertaken before this Court today that they shall not trouble respondent nos. 2 and 3 in any manner, whatsoever and have apologised for their past conduct.

8. Learned Additional Public Prosecutor (“APP”) for the State, on instructions, submits that since the FIR has still not been registered and the concerned parties have already settled the matter, they have no objection if the present petition is allowed.

9. Accordingly, considering the submissions made before this Court and with the consent of the parties, the order dated 06th May, 2026, passed by the Additional Sessions Judge (FTC), South-West District, New Delhi, in CR 412/2025, is accordingly set aside.

10. However, it is clarified that this Court has not expressed any opinion on the merits of the order dated 06th May, 2026, as aforesaid.

11. The present order has been passed solely on the ground of the statement made by respondent nos. 2 and 3, who submit that they do not wish to pursue the case against the petitioners herein.

12. Noting the aforesaid, the present petition is allowed and accordingly disposed of.

13. Pending application also stands disposed of. MINI PUSHKARNA, J SEPTEMBER 28, 2026/SK
