1. This hearing has been conducted through hybrid mode.

2. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [hereinafter referred to as ‘BNSS’], seeking quashing of FIR No. 127/2018 dated 28.02.2018, registered at Police Station Mehrauli, South District, Delhi, under Sections 376, 377 and 420 of the Indian Penal Code, 1860 [hereinafter referred to as ‘IPC’], and all consequential proceedings emanating therefrom, including proceedings in SC No. 93/2020, pending before the learned ASJ, Saket Courts, Delhi, on the basis of an amicable settlement arrived at between the petitioner and respondent No. 2 vide Memorandum of Understanding [MoU] dated 25.07.2026.

3. Issue notice. Learned APP for the State accepts notice on behalf of the State.

4. Both the petitioner and respondent No. 2 are present before this Court and have been duly identified by their respective learned counsel[s] and the concerned Investigating Officer [IO].

5. Briefly stated, the petitioner and respondent No. 2 became acquainted in 2014. Respondent No. 2 thereafter lodged the aforesaid FIR alleging that the petitioner had established physical relations with her on the promise of marriage and had caused her to incur certain expenditure. Upon completion of investigation, a charge-sheet was filed and charges were framed on 04.05.2023. The matter is presently at the stage of prosecution evidence [PE].

6. During the pendency of the proceedings, the parties amicably settled their disputes vide MoU dated 25.07.2026. Respondent No. 2 has stated that she does not wish to pursue the criminal proceedings and has no objection to quashing of the aforesaid FIR and consequential proceedings. The settlement is stated to be without any monetary consideration.

7. On a query made by this Court, respondent No. 2, who has been duly identified by the Investigating Officer [IO], has stated that she entered into the MoU dated 25.07.2026 of her own free will and without any pressure, coercion, undue influence or threat. She has further stated that she does not wish to pursue the proceedings arising out of the aforesaid FIR and has no objection if the same and all consequential proceedings emanating therefrom are quashed.

8. In view of the above, since the parties have amicably resolved their differences of their own free will and without any pressure, coercion, undue influence or threat, no useful purpose would be served by continuing the proceedings. Rather, continuation of the proceedings may only give rise to further acrimony between the parties. In these circumstances, this Court is of the view that the interest of justice would be served by bringing the proceedings to an end.

9. Accordingly, FIR No. 127/2018 dated 28.02.2018, registered at Police Station Mehrauli, South District, Delhi, under Sections 376, 377 and 420 IPC, and all consequential proceedings emanating therefrom, including SC No. 93/2020, are hereby, quashed.

10. Therefore, the present petition is allowed and thereby, disposed of.

11. The pending application also stands disposed of.

12. A copy of this order be sent to the concerned learned Trial Court for necessary information and compliance.

13. The order be uploaded on the website forthwith. MADHU JAIN, J SEPTEMBER 28, 2026/prg/PG
