3. Issue Notice.

4. Learned APP for the State accepts notice on behalf of the State.

5. Both the petitioner and respondent No. 2 are present before this Court and have been duly identified by their respective learned counsel[s] as well as the concerned Investigating Officer [IO].

6. Briefly stated, the petitioner and respondent No. 2 were married on 11.12.2018. Owing to matrimonial differences, they started residing separately, whereafter the aforesaid FIR came to be registered at the instance of respondent No. 2. During the pendency of the matrimonial proceedings, the parties amicably settled their disputes on 14.07.2021, pursuant whereto the petitioner agreed to pay a sum of ₹3,00,000/- towards full and final settlement of the claims of respondent No. 2. The marriage between the parties was thereafter dissolved by mutual consent vide decree dated 09.06.2022, and the entire settlement amount stands paid. A charge-sheet has also been filed in the aforesaid FIR.

7. Learned counsel for the petitioner submits that, in terms of the settlement dated 14.07.2021, the parties agreed to settle all their matrimonial disputes for a total sum of Rs. 3,00,000/-, towards full and final settlement of the claims of respondent No. 2, including istridhan, dowry articles and maintenance, past, present and future. It is submitted that the petitioner paid the said amount in two equal installments of Rs. 1,50,000/- each, at the time of recording of the statements in the first and second motions respectively, which payments stand acknowledged by respondent No. 2. It is further submitted that, with payment of the entire settlement amount, the monetary terms of the settlement stand fully complied with and no amount remains payable to respondent No. 2 thereunder.

8. On a query made by this Court, respondent No. 2 has stated that she entered into the settlement dated 14.07.2021 of her own free will and without any pressure, coercion, undue influence or threat. She has further stated that she has received the entire settlement amount of ₹3,00,000/- and has no objection if the aforementioned FIR and all proceedings emanating therefrom are quashed.

9. In view of the above, since the parties have amicably resolved their differences of their own free will and without any pressure, coercion, undue influence or threat, no useful purpose would be served by continuing the proceedings. Rather, continuation of the proceedings may only give rise to further acrimony between the parties. In these circumstances, this Court is of the view that the interest of justice would be served by bringing the proceedings to an end.

10. Accordingly, FIR No. 263/2021 dated 14.07.2021, registered at Police Station Tigri, South District, Delhi, under Sections 498A and 406 read with Section 34 IPC, and all proceedings arising therefrom are hereby quashed.

11. Therefore, the present petition is allowed and thereby, disposed of.

12. Pending application[s], if any, also stand[s] disposed of.

13. A copy of this order be sent to the concerned learned Trial Court for necessary information and compliance.

14. The order be uploaded on the website forthwith. MADHU JAIN, J SEPTEMBER 28, 2026/b/PG
