1. By way of the present petition under Article 226 of the Constitution, the petitioner, who is the intending purchaser of a plot of land measuring 250 sq. yds. (209.03 sq. mts., i.e. 5 Biswa), out of the total land measuring 400 sq. yds. comprised in Khasra No. 154/685 (0-8), situated in the extended Lal Dora of Village Pooth Khurd, Tehsil Narela, District North-West, Delhi – 110039 [“subject land”], seeks a direction to the respondent, Government of National Capital Territory of Delhi [“GNCTD”], to register the Sale Deed dated 24.08.2026 executed in her favour pursuant to her purchase of the said land from the erstwhile owners, namely, Sunita Shedha @ Sunita Devi and Mrs. Nirmal Devi Shedha @ Nirmal Devi.

2. The case of the petitioner is that registration of the aforesaid Sale Deed has been refused on the ground that consolidation proceedings in respect of the subject land are still pending and that the petitioner has not furnished a No Objection Certificate [“NOC”] and/or Land Status Report [“LSR”].

3. Mr. Vinay Dabas, learned counsel for the petitioner, submits that the only impediment to the issuance of the NOC/LSR is the pendency of consolidation proceedings in respect of Village Pooth Khurd. Mr. Dabas relies upon the orders passed by this Court in Okaya Infocom Pvt. Ltd. and Anr. v. Govt. of NCT of Delhi and Anr.1, Smt. Nirmala Devi and Ors. v. Govt. of NCT of Delhi & Anr. and connected matter2, and several subsequent orders3, as well as the Circular dated 14.08.2025 [“Circular”] issued by the GNCTD, whereby the procedure for registration of land documents has been streamlined and registration has been permitted subject to the purchaser undertaking to abide by the outcome of the pending consolidation proceedings.

4. It is also noted that the Sale Deed records that the subject land is not subject to any acquisition proceedings.

5. Mr. Dabas further submits that the petitioner is agreeable to purchasing the subject land on the aforesaid terms and undertakes to abide by the outcome of the pending consolidation proceedings, without prejudice to the rights and contentions of any third party.

6. In view of the aforesaid, the present writ petition, alongwith the 1 W.P.(C) 12122/2021, decided on 10.11.2023. 2 W.P.(C) 4046/2025, decided on 01.04.2025. 3 Chandan Sawhney v. State (NCT of Delhi) [2024 SCC OnLine Del 8421]; Vinod Kumar Rajoria v. Government of NCT of Delhi and Others, [2023 SCC OnLine Del 5446].

pending applications, is disposed of with a direction that registration of the Sale Deed in question shall not be refused merely on account of non- availability of the NOC/LSR.

7. The petitioner shall, however, remain bound by her undertaking to take the subject land, subject to the outcome of the pending consolidation proceedings and without prejudice to the rights and contentions of any third party. The petitioner shall file an affidavit to the aforesaid effect with the Registry of this Court within one week from today, which shall also be forwarded to the concerned Revenue Authority.
