1. This hearing has been done through hybrid mode.

2. The present petition has been filed seeking grant of parole to the petitioner on medical grounds, particularly for the purpose of obtaining appropriate medical treatment and undergoing stoma closure surgery.

3. Learned ASC has handed over the Status Report in Court. The same is taken on record. The relevant portion of the medical verification report reads as under: “Q2. Verification of 15-Day Surgery Timeline & Clinical Fitness: As the attached document notes that stoma closure surgery is scheduled within the next 15 days, kindly clarify whether the patient has undergone recent clinical evaluation by your surgical team and whether he is currently clinically and medically fit for stoma closure surgery within this specific timeline. Ans. The Patient was clinical reviewed on

14.09.2026 and based on the examination he was advised to undergo stoma closure. From a surgical perspective, stoma closure may be performed once the Patient is considered fit for the procedure. In view of the patient's high stoma output and the associated risk of ongoing nutritional and weight loss, it would be preferable to undertake stoma closure at the earliest appropriate opportunity, subject to surgical and anaesthetic fitness. However, the Patient requested that the stoma closure procedure performed within 15 days.”

4. The Status Report further indicates that the petitioner had earlier been admitted at Max Super Speciality Hospital, Saket, from 01.08.2026 to 05.08.2026 on account of abdominal pain and high-output stoma with dehydration. The medical records placed on record indicate that the petitioner continues to require stoma care and that stoma closure has been proposed, subject to his being found fit for the procedure.

5. Learned ASC submits that, as per the verification report, the petitioner may undergo the proposed surgery at any Government hospital, subject to his clinical and surgical fitness.

6. Learned counsel for the petitioner submits that the petitioner had earlier been taken to AIIMS for treatment, however, the surgery could not be undertaken on account of his low body weight. It is further submitted that the petitioner requires a protein-rich diet to improve his physical and nutritional status so as to enable him to undergo the proposed stoma closure surgery. The petitioner has also placed on record that the stoma bag requires frequent emptying and cleaning and that he continues to remain dependent upon assistance for the same.

7. Having considered the submissions made by learned counsel for the parties and the medical material placed on record, this Court is of the view that the petitioner requires an opportunity to obtain the requisite medical care and to have his fitness for the proposed stoma closure surgery assessed. The medical verification itself records that stoma closure has been advised, subject to the petitioner being found surgically fit.

8. In the facts and circumstances of the case, the petitioner is granted parole for a period of 15 days from the date of his release, subject to the following terms and conditions:

i. The petitioner shall furnish a personal bond in the sum of Rs. 10,000/- with one surety of the like amount, who shall be a family member, to the satisfaction of the- Jail Superintendent concerned.

ii. The petitioner shall report to the SHO concerned of the local area once a week on every Sunday between 10:00 AM to 11:00 AM during the period of parole.

iii. The petitioner shall reside at the address mentioned in the present petition during the period of parole.

iv. The petitioner shall surrender before the Jail Superintendent, immediately after the expiry of the period of parole.

9. A copy of this order be sent to the concerned jail Authority/superintendent.

10. Accordingly, the present petition is disposed of. Pending application(s), if any, also stand(s) disposed of.

11. The order be uploaded on the website forthwith. MADHU JAIN, J SEPTEMBER 28, 2026/prg/P
