1. The applicant seeks regular bail in Bail Appln. No. 1921/2026. The charge sheet has been filed under Sections 126(2)/3(5)/110/117 of the Bharatiya Nyaya Sanhita, 2023.

2. The incident alleged in FIR No. 419/2025, dated 07.09.2025, registered at PS Budh Vihar, Delhi, took place during the intervening night of 06.09.2025 and 07.09.2025.

3. The FIR discloses that a group of persons assaulted the complainant. Certain injuries were suffered by the complainant.

4. The applicant has been in custody since 21.09.2025, i.e., for more than a year. The State and the complainant oppose bail. They point to the grievous injury, the applicant’s other cases, his jail conduct, and the audacious conduct of the accused persons in making a video recording of the incident and uploading the same on Instagram.

5. At the outset, it is noticed and fairly acceded to by learned APP that the FIR named the applicant only in passing. It is recorded that a co-accused (Lalu) called out to “Irfan, Dilshad, Ali” to come; the FIR discloses that the beating had already been inflicted on the victims prior thereto.

6. What further weighs with the Court is the fact that the investigation is completed. It is submitted that the chargesheet was filed on 13.11.2025. The charges have not yet been framed. Clearly, the conclusion of trial will take a considerable period of time.

7. The sections referred to in the chargesheet carry a maximum sentence of seven years. As noted, the applicant has spent more than one year in custody. Continued detention before trial in these circumstances would become punitive.

8. In the circumstances, the applicant is admitted to regular bail on furnishing a bail bond in the sum of Rs. 50,000/-, with two sureties of the like amount to the satisfaction of the Trial Court, subject to the following conditions: i. The applicant/accused shall not leave NCT of Delhi or travel out of the country without prior permission of the Trial Court; ii. The applicant/accused shall provide his permanent address to the Trial Court, and also the address where he will be residing during the pendency of the case; iii. The applicant/accused shall intimate the Investigating Officer (IO) and file an affidavit before the Trial Court regarding any change in his residential address; iv. The applicant/accused shall furnish his mobile number to the Investigating Officer (IO)/Station House Officer (SHO) concerned, which shall be kept in working condition at all times. The mobile number shall be kept switched on, with location services enabled at all times, and the same shall be shared with the IO. The mobile number shall not be changed without prior intimation to the IO during the pendency of the trial; v. The applicant/accused shall report to the IO as and when called for by the IO. vi. The applicant/accused shall not directly or indirectly contact the complainant, any prosecution witness, and their family members; vii. The applicant/accused shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case, or tamper with the evidence of the case, in any manner whatsoever; viii. The applicant/accused shall appear before the Trial Court on each and every date of hearing; ix. The applicant/accused shall not indulge in any criminal activity during the period of bail; and x. The applicant/accused shall report to the concerned SHO, on the first Monday of every month at 11:00 a.m. and be discharged by 12:00 noon, after recording his presence and completion of the necessary formalities.

9. If any of these conditions is breached, the complainant would be at liberty to seek cancellation of bail.

10. The applications are disposed of in the above terms. The pending application also stands disposed of.

11. The Trial Court is requested to expedite the trial proceedings to the extent feasible.

12. It is clarified that the observations made herein are solely for the purpose of deciding the present bail application and shall neither influence the trial proceedings nor be construed as an expression of opinion of this Court on the merits of the case.

13. Let a copy of this order be communicated to the concerned Jail Superintendent electronically for information and necessary compliance.
