1. This petition has been filed for setting aside order dated 28th July 2026 passed by the Motor Accident Claims Tribunal, West District, Tis Hazari Courts, Delhi (‘MACT/Tribunal’) in MACT No.393/2025.

2. The challenge in question is to order dated 24th March 2026, whereby, an opportunity was granted to driver and owner to file Written Statement subject to costs of Rs.10,000/-.

3. Mr. Dinesh Sharma, counsel for petitioner, states that due to a mistake by his junior associate, he had been unable to present the fact before MACT that Written Statement/Reply had already been filed on 16th June 2025 which had been supplied to the counsel for claimant and proof of the same has been provided as Annexure P-4. This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 01/10/2026 at 11:09:14

4. Moreover, he states that it was noted in the same order that a separate claim petition had been filed on behalf of claimant, copy of which had only been supplied to the Insurance Company, therefore, he did not have a chance to file his amended written statement. He states that a copy of the subsequent claim petition has been now supplied to him.

5. In these circumstances, in the interest of justice, and not to disentitle driver and owner of the offending vehicle, to place his defence, they shall be allowed to file their Written Statement, within the next week with a copy to the counsel for claimant, as well as, the counsel for Insurance Company. If the same is not filed within next week, costs of Rs.10,000/- directed by MACT will be paid, and no further opportunity will be given.

6. The matter will be taken up by MACT and driver and owner will have a right to participate in proceedings.

7. Mr. Dinesh Sharma, counsel for petitioner, undertakes that the driver and owner will be represented before MACT and no adjournments will be sought.

8. Accordingly, petition stands disposed of in view of the above. Pending applications are rendered infructuous.

9. Copy of this order be sent to the concerned MACT for information and necessary compliance.

10. Order be uploaded on the website of this Court. ANISH DAYAL, J SEPTEMBER 25, 2026/ak/sp
