1. This hearing has been done through hybrid mode.

2. By way of the present petition, the Petitioner is seeking quashing of FIR No. 293/2019, registered at Police Station – Kanjhawala, Delhi, for the offences punishable under Section 363 of the Indian Penal Code, 1860 (hereinafter referred to as ‘IPC’), and all consequential proceedings emanating therefrom on the basis of the settlement arrived at between the parties.

3. Issue notice. The learned APP accepts notice on behalf of the State.

4. The Petitioners and Respondent No. 2 are present before this Court and have been identified by the Investigating Officer.

5. The Petitioner and Respondent No.2 got married according to Hindu rites and ceremonies on 25.07.2019 and, out of the said wedlock, three children were born. Thereafter, certain differences arose between the parties, pursuant to which, on the complaint of the mother of Respondent No.2, FIR No. 293/2019 was registered at P.S. Kanjhawala, Delhi, under Section 363 of the Indian Penal Code against the Petitioner, and the chargesheet was filed on 20.08.2021. Subsequently, the Petitioner and Respondent No.2 entered into a settlement deed dated 08.09.2026, pursuant to which Respondent No.2 has no grievance against the Petitioner and has agreed to cooperate in the quashing of the aforesaid FIR. The Petitioner and Respondent No.2 are presently residing together. Accordingly, the Petitioner seeks quashing of FIR No. 293/2019 and all proceedings emanating therefrom.

6. On a query made by this Court, Respondent No. 2, who has been identified by the IO, has categorically stated that she has entered into compromise, vide Settlement Agreement dated 08.09.2026, of her own free will and without any pressure, coercion or threat. Therefore, she has no objection if the present FIR is quashed.

7. The Court has considered the submissions advanced by the parties and has interacted with Respondent No.2. The parties have resumed cohabitation and are presently residing together along with their minor children. Respondent No.2 has reiterated before this Court that she does not wish to pursue the present proceedings against the Petitioner.

8. In view of the above, the parties have amicably resolved the differences of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings; rather the same would create further acrimony between them. It would thus be in the interest of justice to quash the above-mentioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

9. Accordingly, FIR No. 293/2019, registered at Police Station - Kanjhawala, Delhi, for the offences punishable under Section 363 of IPC along with all consequential proceedings emanating therefrom, is hereby quashed.

10. The present petition is disposed of. Pending application(s), if any, also stand(s) disposed of.

11. The order be uploaded on the website forthwith. MADHU JAIN, J SEPTEMBER 25, 2026/ys/yt
